Speeding Ticket Question

I got done for speeding on the eurotoll there a a few weeks back, I was doing 147km in a 120km zone, I've been driving for 5 years and never been pulled etc but she told me I was going to be fined and get 2 points, she was nice enough about it as to be completely blunt about it, I was taking the piss.

However, I don't know the process now, I've hear nothing since, am I supposed to get something in the post which I then take to the station to pay the fine with? Or (deep breath) have I gotten away with it? 25 days and no word seems like a long time to me...

I'm sure someone will reply with more exact figures, but yes, you can expect a notice in the post. It can take quite a while before it gets to you...

apparently if you dont pay and are called to court..if you claim non receipt of the letters they will throw the case out !!!

Now i'm not advocating you lie in court..but apparently this has worked for other people in the past!! :o

I think if they haven't either got you to accept the points and fine or summonsed you to court within six months the penalty is statute barred?

Can anyone confirm that - i'm sure I read it in legislation somewhere

The summons must be applied for within 6 months of the notice. They can serve the summons after the 6 month period if they want.

Interesting. Makes sense. Any time limit on serving the person?

summons applied for before the six month deadline would usually be served for court within a month or two...

    but...

i kno a guy that didn't get his summons until 15 months after the incident.... it had been applied for before the six month deadline but garda had to keep re-applying cos they couldn't get him at the address.... garda applied for 5 or 6 summons before it was actually served.... judge threw it out of court cos it was "unacceptable"... this was a drink driving case though and probably an exceptional circumstance

If by hand, 7 days before the court hearing. If by post, 21 days.

AFAIK, for a non-indictable offence, the summons has to be served within 18 months of the offence
