Appealing a test

    So heres my story.....My own cars steering packed in last week so as I was due to sit my test today I got a lend of a car from my Garage last Thursday and transferred my Insurance over from my car to the garage car until it was fixed .

    The insurance company sent my out a 'certificate' stating that the transfer was complete and I was know fully insured on the Garage car . Car details + registration number were all included in this cert .

    So I arrived at the test centre this morn in the Garage car with :

    * My original car insurance disc (in the car window) + all the letters etc that
    came with it .
    * The insurance certificate for the garage car stating I was fully insured on
    this car , and that it was temporary. Both car details were on this cert
    saying I had temporarily transferred from my own car to garage car .


    So , went into my test this morn with SGS . Theory part and questions went all ok . As soon as the tester seen the insurance disc she refused to get into the car ,as that disc in the window didn't match the car .

    After 15 minutes explaining the situation i gave up. She wouldn't even look at the cert .

    Rang the insurance company after and they said the cert the issued is what they send out in these situations and is sufficient. They do not issue Temporary insurance discs for matters like this .

    Rang SGS and was told the testers decision is Final and to ring RSA if i want to appeal.

    I know appealing will only get me my €38 back but if i'm in the right I'll go ahead with it . Have to wait another 2 months now and will have to do it in Wilton too .

    Is this worth appealing ??

    I think you might be wasting your time appealing. Testers are only obliged to take a car out if the reg on the ins disc matches the reg on the car. Letters, phone calls or temporary certs are not acceptable as unfair as this may seem.

    If you do appeal it and are successful all you'll get is another test, but to do this you'll have to take the case to the Circut Court, so is it worth that expense and hassle.

    You appeal it to the District Court not the Circuit Court. It costs €20 and if sucessful, you get to sit the test again.

    The garage should have had their own insurance disc displayed with the company name shown instead of a reg number. That would have saved you all of this hassle, and the €75 for another test.
    I wouldn't appeal this as you are not allowed dislay a disc with a different reg number than the vehicle on which it is displayed. Don't go on what the insurance company tell you, they aren't conducting the test.

    From section 5 of http://www.drivingtest.ie/drivingtest/finalchecks.pdf

    "You must be insured to drive the vehicle. The vehicle must display a current valid original Insurance
    Disc (white background with a green band extending along left hand side). The disc must clearly
    show the Registration Number (or fleet name) of the vehicle (not Chassis Number)
    and the policy
    dates. If the details are faded you should get the disc replaced prior to the test. You will be asked to
    read and sign a statement confirming that the vehicle insurance cover is in place and is adequate."

    FYI, if you move to a 'smart' meter electricity plan, you CAN'T move back to a non-smart plan.

    You don't have to take a 'smart' meter if you don't want one, opt-out is available.

    Buy drinks in 3L or bigger plastic bottles or glass bottles or cartons to avoid the DRS fee.

    As Brian said the disc must relate to the car, Its on ur list for preparing for test sgs send out with your date, The judge in the district court will look how she handled the test, did she do anything wrong?

    And the answer is she didnt,

    It is up to you to provide a car that meets the criteria set down in the rules for the test and you didnt

    I would suggest you put it down to experience and dont waste your time and money.

    On the other hand all sgs testers are unemployed from friday so they might not appear in the court(they wont be paid for it) when appealing your test, Judge couldnt really go against you if they dont show up
