    I have recently been suspended from work for 'Gross Misconduct' for an old email folder which I have not visited in a long time. This could contain some inappropriate material but I believe the majority of it is jokes, I cannot say for certain what is in it as it has been so long. I understand my stupidity for keeping a folder with this material on it but at the same time I am wondering if anybody can advise where I stand? Any assistance would be appreciated.

    Were you receiving these emails and just storing them? That's not so bad.
    After all, except for asking people to stop, there is not a lot you can do about who emails you.

    But if you were forwarding them that's completly different and far more serious.

    I seem to remember Morgan Stanley Dublin sacked over 10 people about 4 years ago when an inappropriate email got forwarded to a client who complained. There were others disciplined too

    What did your IT Policy say when you signed it, or failing that, your contract with regards to Internet/Mail usage and reasonable expectation of the company searching/monitoring same?

    I used to get some "jokes" in e-mail at work some of which bordered on the dangerous territory of gender and race etc.
    These subjects and religion, nationality,travellers etc should be avoided like the plague and immediately deleted.
    Stick to your work at work and leave the social stuff for later.

    In these times employers are only itching for an excuse to get rid of people on the cheap and the email abuse or racial abuse infringment is a great excuse to do so.
    Don't give them the ammunition to use against you.
    On lighter note I recall one colleague who replied to the news of the arrival of our bosses 4th daughter with some remark alluding to the absence of sons.
    He inadvertantly replied to all, including the original mailer:- the boss.

    The boss was not impressed and brought it up in a public meeting in an amused manner, putting the colleague in an embarrassing position.
    Email is dangerous because it is quick to write and disseminate but gives the impression of being ephemeral, like speech.
    It is in fact permanent and can last for years.

    You cant be blamed for receiving emails but storing or forwarding would normally result in disciplinary action. Why would you store them anyway?

    I dont think you can be blamed for storing them either if emails are bulk stored...

    It really depends what the content is....... but bottom line is that when companies want to cut down numbers then this is the way they do it, technically most people who post on boards while are working could be done for the same :eek:
