2 people would be in trouble :

1 - the driver for carrying mre people than the car is permitted to

and

2 - the person wearing no seatbelt if he/she is over 18 (if they are under 18 then the driver gets in trouble for it)

but in reality im sure the guard will just prosecute the driver for being a fool and carrying 4 people in the back in the first place.
