Sleazy webcam job in the back of the car, like. Or is that illegal?

Must be considered on invasion of privacy towards the tester.

+1. That'd be my thought on it. Why on earth would you want to?

Genius idea. Not going to give my reasons why I think this though.

Can you whack a camera out the front of the car then so it doesn't show the tester?

I'm not sure of the law concerning this either, but I do know that there are specific cameras available to buy that attach to the rear view mirror, pointing out towards the road.
In the USA many cars are now fitted with such cameras for insurance purposes. It eliminates any doubt when small accidents occur, and also catches some accidents that happen in the vicinity.

Does this mean that the driving test has succumbed to Rule 34?

I think filming the tester would be unwise, however an audio recording would probably not be prohibited.

The media do audio recordings of public servants all the time so it can't be too illegal.

If you were to appeal the testers decision it would not be admissible in court unless the tester was informed that he was being monitored.

If you were to appeal the testers decision
One cannot appeal the tester's decision. One can only appeal for a re-test. The original decision stands.

    According to this:

you can appeal your driving test. Although I can't imagine many people do this, never mind being successful in it! It seems a completely pointless exercise, as all you can get is another chance to do your test.

The court cannot reverse the original decision of the tester. If the appeal is successful, the candidate merely gets another opportunity to be tested.

    (5) ( a ) A person aggrieved by the deferring of a decision under subsection (4) of this section may appeal to a Justice of the District Court having jurisdiction in the place in which such person ordinarily resides, and the Justice may either refuse the appeal or direct that the application shall be dealt with without requiring a certificate of fitness.

( b ) A decision under this subsection of a Justice of the District Court shall be final and not appealable.

Sorry, should have clarified that's what I meant. It's a completely pointless process, probably cheaper just to do the test again yourself!
