Entitled to P45?

    Hi guys,

    My employment officially ended on the 23/03/2009. I am currently appealing the dismissal.

    As I am not being paid whilst the appeal process goes through, I need to claim social welfare benefits. They require a P45. After requesting my P45, my employer sent me the following letter:

    'Re:Request for P45
    I wish to acknowledge receipt of your text messages on 24th March 2009 requesting your P45 and your subsequent email again of 24th March 2009 requesting as a matter of urgency your P45.

    I understand your solicitor has written to the Company to appeal notice of your dismissal with effect from 23rd March 2009. In light of your request for your P45 am I to take it that you are withdrawing your appeal and your dismissal is being effected and will take affect forthwith.

    Yours sincerely,'

    Am I legally entitled to a P45 from my employer because my employment has been terminated or do I have to wait until the process goes through?

    Seeing as you have gotten your solicitor involved, make all future contact through the solicitor.

    If you try to bypass him/her and discuss things with the company involved, it may hinder your case.

    I do not have a legal background and these are purely my thoughts. Speak to your solicitor about it first and always.

    I couldn't agree more. Do not even respond to them to tell them that you are referring this to your solicitor. Let them handle all the contact. And if you can't do this, for the love of God, don't send text messages.
