crashed in to a horse today

    today i was driving with my instructor on local road.I was doing about 60-70km/h .Then suddenly horse jumped in the road,about 5 meters in the front of my car.I braked real hard,but hit the horse.Turned on warning lights,and left car on the road. Bonnet broken,windscreen broken,mirror broken...Instructor called to garda,and minutes later garda and farmers son showed up.Garda took all the details,and he said,it was not my fault.Farmer who owns the horse is on hollidays at the moment,so we really dont know if he was insured.Anyway farmers son said if farmer not insured,he is going to pay with cash.We moved the car to garage,witch going to prise the repair costs.Mechanic said estimated cost1500-2000€.The worst thing is,that i bought the car only monday,got insured over the phone yesterday.Don't have a insurance disk yet,so garda told to me that i must bring insurance disk to garda station in 10 days. Its 2002 peugeot 307 btw.Should i ring to my insurance company,and report accident?Will reporting have any effect on my insurance premium cost?

    I am afraid the bad news is that a horse has more right on the road than a car and I think in all cases of a collision the car is in the wrong, it goes back to old times. If it was a dog, cow or other animal the owner would be liable.

    No harm reporting it to your insurance, just point out that you won't be claiming on the accident, just in case the farmer starts calling looking for money. Sounds like you did all the right things, so don't worry.

    Bear in mind that car-hire is going to be pricey enough for the time that is required to find a garage and get it repaired.

    Presumably that would be a horse under the control of a person though. Not one that can freely jump out on the road.

    is it not that the horse + rider has right of way, similar to pedestrian, horse without rider (sounds like escaped from paddock or yard) reverts to "animal", and owner has responsibility for horses actions?

    So was the horse killed outright?

    Why no mention of the poor horse's fate?

    There he was enjoying a nice stroll in the spring and some learner driver comes along at 70km/h and hits him.
    I'm with the horse on this one.

    The animal wasn't under control so I wouldn't say you will be liable. Tell your insurance company, just to play it safe. Make it clear you are not claiming. Was the horse killed?

    the law has changed in this. Any unattended loose animal and any damage it causes is the responsibility of the owner whether he is insured or not. With regard to your insurance, if you have paid your premium you should have no problem. Also I am sure if you check the small print on your policy, you may be obliged to inform your insurance company of any accident whether it was your fault or not. If you ever have to claim off your insurance the premium would not be affected until your next renewal.

    i hope that's not how backward some of out laws are. op should be able to sue farmer along with repairing car imo.

    DEFINITELY report it to your insurers.

    As stated you are obliged to under your policy but also there may be comeback.

    A lad i know was knocked off his bike by a man in a car who suddenly pulled a 3 point turn on a main road in dublin city centre.

    Witnessed by lots, three of the witnesses supplied names and addresses to the lad and offered every support. Car driver apologised profusely and offered to pay for the damage straight up! This lad was fairly bruised and there was light damage to the bike but decent sort he is, he accepted the apology from a genuinely repentant motorist and went on his way with no money or intent to claim in any way.

    Weeks later he gets a letter from the motorists insurance company looking to recover the cost of repair to his vehicle ( front end damage)!!!!:eek:

    So the lad rings the motorist, who is totally unaware of this and had the damage repaired under his fully comp insurance. Motorist rings his insurers who tell him it's none of his buisness, they are handling it as entitled to under policy. Motorist is sorry but can do nothing.

    So lad has to get a solicitor to act on his behalf and sort it out!

    Insurers are ( insert all expletives you can think of and then some)

    So to avoid any future hassle for yourself let them know all.

    Sorry to hear of your misfortune, don't let it put you off!

    OP; hopefully you've gotten any bad luck out of the way early in your driving lifetime!

    Inform your insurance company, giving them details of the farmer, the witnesses, and the gardai who attended the scene.

    Best of luck with getting it sorted out.

    Unlucky there. Not your fault though, the horse is ok and the farmers son seemed sound out! Could be worse.

    Amazing the horse was allright, any human getting hit at anything near 70kmh would nearly 95% have no chance of survival.

    Sounds like OP was very lucky as if the horse went through the windscreen like the pictures above would be lucky to survive.

    I think the farmer is only liable if he has not taken due care to ensure the horse is locked up in the field. (e.g. fence was broken). AFAIK if the horse was able to jump for example a 10 foot fence or similar then the farmer is not liable.

    there was no gates at all in field...;) i still don't understand what the hell that horse was doing in that field
