Court summons for parking fine - 6 months gone

I received a court summons in the last week of February for an unpaid parking fine going back to July last year. I never received the original fine in the post so how i was expected to pay it i don't know! Anyways, the date on the summons is 15 Dec 2008 with 26/01/09 in brackets written in biro after it. But the thing is, i only received it on the 26th of February! Now this is more than six months after the date of the offence, can the judge strike it out for this alone?
Obviously i'm gonna say i never got the fine notice, because i didn't. But the fact that more than the allowed 6 months has passed since the original offence was committed, does this mean the prosecuting guard has messed up and doesn't have a case??

I think if they applied for the summons on 15/12/08 then they were still within the 6 months.

I got 60 euro fine with four months to pay. I"ll take it, the fine didn't increase so its grand. Even if i did spend half the day waiting, surrounded by scumbags and the smell of cheap washing powder.
