Not displaying tax disk

    Hi,I recently recieved a summons for not having a valid tax disk in the window of my car last July 13th. I am due to appear in court for this offence around the end of April. for motor offecnces do you not need to be processed within 6 months? It is a council fine, not one from the garda. (I was out of the country and only returned, the car was not on the road for 6 months and was taxed from mid july onwards. (obviously after the 13th). )Cheers

    I can't comment on the timeline involved but I will say that if your car was parked on a public road and not private property it will be classed as 'on the road' regardless of it not being used.

    Tax runs from the start of the month,so if it was taxed from mid july,it would cover back to beggining of july.If so,this would help when you get to court.

    As far as I know, the Garda just needs to apply to the Courts for a summons within 6 months of the offence. It doesn't mean that they have to bring you to court within 6 months of the offence.

    I'm in the same boat as the OP, except that mine is a Garda Summons. I have been summoned for June. I have never been to court for anything and I have no idea what to expect! Can anyone give me an idea?

    Mods, I am not asking for legal advice, just a general idea of what will/could happen!

    to avoid a hefty fine claim poverty... unemplyed & supporting a few kids... they have to take your word for it :pac: they will fine you 50euro. this is the advice the summons officer gave when he delivered the summons, a nice guy.

    No tax displayed comes under the Finance Act so the time limit to issue proceedings is twelve months, but taxing the car from the beginning of the month July will help your case in court as hopefully they will look at it as no loss to revenue

    I would suggest taxing your car back to the date it expired (or when you took ownership). Bring ALL receipts to court and show them to the guard before your case is called. You'll need to prove that there is no loss of revenue. Not a biggie - don't sweat it!

    If its only for non display then as deadwood said dont sweat it, its only a very minor offence and happens everyday in court. The above advice is good so take heed, but be aware that the offence is non display of tax so having tax doesnt matter if it wasnt displayed. But having it back taxed should help you, depending on the Judge and Court area.
