time off + worked time,redundancy???

    HI:
    Maybe someone here can help me out to find the answer to the following:

    -I have worked for a the company for 98 weeks , in that period I took only 1 week off, as they still own me 3 weeks vacation from 2007 and still didn't take the 4 weeks corresponding to 2008 they agreed to pay me those 7 weeks.

    My question it's: Can I add those 7 weeks to the 98 worked to qualify for a 104 weeks redundancy?

    Any help will be appreciated.

    afaik If since you have started with the company you have been employed by them for a duration of 98 weeks then that's what your redundancy is based on, regardless of whether or not you were on holiday.

    Your holidays that are due to you that they have agreed to pay should be a different payment.

    Have a word with your employer, he may agree to allow you to take your seven weeks holiday and then make you redundant after you come back to work. That would be perfectly legal. There's no real reason why he shouldn't.

    Thanks for the answers,I was expecting to get the redundancy ,but if I can't at least I will have those unpaid weeks to hold on for a while.Thanks

    Talk to the employment rights section of the Department of Enterprise, Trade and Employment.

    I think you may be on to something. I know that social welfare will only pay unemployment benefit from the time that holidays run out after employment stops so at least one government agency claims that your employment runs out after your holidays.
