If you leave work voluntarily or as a result of misconduct you cannot get a jobseeker’s payment for 9 weeks.

I was sacked for misconduct - I will get nothing for 9 weeks!? Am I expected to be homeless for this period?

    Please advise, thanks.

theres a long wait regardless mate. i waited from 11 december until 16 february for my first payment, and i had been let go. if you're very stuck, maybe you could try to get some emergency welfare from the community welfare officer, thats on Millmount road if you're in Dublin.

Did you get it backdated though? You don't if you have been sacked for misconduct. :(

I am desperate but it says you are disqualified for 9 weeks. I hate even claiming it but I will be out on the street if I don't and I suppose I will have to be for 9 weeks at least before they even process my claim - never mind a few bob to catch the train to interviews.

yeah, i got it backdated alright. twas a lean 2 months though. i'll be honest mate, it doesn't look good. you'll be waiting two months minimum, maybe more now. they'll tell you to speak to the community welfare officer if you're really stuck.

Yea, mine WON'T be backdated though because I was sacked. I am taking it to court though for wrongful dismissal. Maybe they will consider that. Thanks for the advice.

irishbrain, nothing is set in stone as far as i know. You'll have to fill forms in as to why you left your job, be it your own reasons or them sacking you. They will consider your case and deal with it on its merits, so you might be ok.

What was the exact reason they sacked you ?

Deliberately going on lunch whilst still clocked into the work clock. I didn't - I am taking it to the EAT.

Irishbrain - you have how many threads started here about being sacked. Can you not put it all in the one thread or do a search before you ask a question as 9 out of 10 times its already being covered somewhere

If that is your biggest worry, you are a very lucky person. Faced with homelessness and you are banging on about a few threads? Can you refrain from commenting unless you have something positive/supportive to say to people going through a rough patch, thanks.

I find checking on the welfare website or citizen advice website answers alot of questions and you may see something yuor entitled to on there to. Also go to your local CWO and tell them you havent enough money to live on.

As far as I am aware, if you are dismissed from work you are entitled to the dole straight away (of course because there is such a backlog you will be waiting a while). The reason why you were dismissed is irrelevant.
There is a qualifying period if you leave work voluntarily, which you did not do?

    Calm down there!
You're not the mod of this thread mate!

If something is out of order report it as it states in the charters.
It also states, as far as I can recall, that before starting threads you should search the fora to see if there's anything similar already existing.

Still, as another poster mentioned being backdated, you refrained from mentioning that you were paid for two months where you weren't working while on suspension.
If I was suspended with pay for two months, I know that the saving for leaner times would have started as soon as I left the premises!
Sounds like it should all balance out at least until your case goes to court.

Not true. You can still be disallowed.

Dont forget there is an appeals system in place. You can appeal the decision on the grounds you may be left homeless,if you have rent to pay.

Phew, I am just back from the social welfare office. They are not going to disqualify me because I am taking legal action and they don't consider taking a long lunch to be serious misconduct. Also, the community welfare officer is going to give me above the rate rent supplment for a short period, but I need to look for a cheaper place.

Great, now I can continue to search for a new job knowing that I have enough to survive on and a roof over my head :)

Not a bad result, good luck with the legal action.
