Loading bays - parking

    Hi. I got a question: Can I park my car at loading bay after hours shown on the sign?

    Example: Loading bay hours Mon-Sat 8am-7pm
    So... everyday after 7pm and whole Sunday, its legal to park there?

    Yes, it's only a loading bay during the hours indicated on the sign.

    Thats right, after 7pm and before 8am you can park aslong as you like. Between the times stated you can only park there for 10 or 15 mins cant remember which to use the shops.

    One of my favourite pet hates, is shop owners who think they own the loading bay outside there shop and put a parking cone on it when they move there own vehicle from the spot.
    Dont they realise the loading bay used correctly encourages more people to use there shop frequently during the day, instead of blocking it all day with there own car/van. If every ten mins it became available the more chance you have to attract business.

    Don't you need a commercial vehicle to use loading bays. Its not so you can pop into shop to get a sambo, its for vans etc to load into shops etc.

    As far as I am aware anyone can use a loading bay for 10 mins, But I could be wrong on that.

    Thanks for reps.. I have a bad situation....

    I leaved my car on loading bay last Monday about 7.45pm (after loading hours) and young kid was running on the footpath and unfortunately hit direct to my car. He split his head and got two little skull fracture.

    Now his mother wants put the case to court, because I shouldn't park my car on the loading bay.

    That's NOT MY FAULT!! Kid was running like blind horse and could hit anything... sign, esb post, traffic light or... my car :cool:

    Should I worry about it?

    You need a goods vehicle to park in loading bay, max 30 mins.

    sounds like you were legaly parked but best advice to talk to a solicitor first.

    Loading bays can differ from area to area. Usually they just become normal parking spaces after the loading bay hours unless otherwise stated.

    For example, the loading bay outside my shop is a loading bay from 6am to 1pm, a clearway from 1pm to 6pm, Monday to Saturday, and regular parking at all other times. It has a 30 minute maximum loading time

    Technically you are supposed to have a commercially taxed vehicle to use them, but some local authorities allow a shorter length of time for privately taxed vehicles (a lot of business' don't have commercial vehicles, as they can be too small for the owners to afford to run a commercial vehicle as well as a private vehicle, and these people have to be allowed go about operating their business).

    As for the child hitting the car, IIRC if the car wasn't moving it then it isn't your fault, even if it turned out that you were parked illegally.

    A) Let the Gardai know what is going on, and about the threats being made.
    B) Check for CCTV, either on the street or from any local business.
    C) Ask the local authority for their guidelines regarding their loading bays.
    D) Chat to a solicitor.
    E) If there is the slightest sign of damage to your car as a result of the child, think about going after the child for vandalism (not necessarily to follow through with it, but it might put a halt to the womans gallop).

    Jaysus.. imagine your car was not there! The kid would still have tripped and fallen but instead of hitting your car, probably would have ended up on the road under the wheel of another vehicle.

    She has no case at all, if it ever makes court it would have to be thrown out. In fact, if there is damage to your car as a result then you have a better claim against her/her son.

    Anyway a loading bay, just like a Bus lane is fair game after the specified time and unless the sign says otherwise, for instance loading bay until 7pm and taxi rank after that.

    I hope you get money for damage to your car. The kid fell into a car, so they want to sue you!? Stuff like that really p!sses me off. Best of luck with it

    Nice one, it was ridiculous to claim you were at fault. Regardless of whether you should have been there, her child would have run into an actual commercial vehicle if you weren't there or ended up lying on the road.

    sounds like she had a chat with a solicitor and he told her she had no case .... if there was damage to your car you are entitled to claim for that. (very rarely done - but legally its the kids fault - or parents fault for not having control of her child)
