Did a BIN on eBay - can I return goods?

    I purchased a Adidas Hoody on eBay last week and it arrived on Monday by normal post. The thing is it's a little small on me (even though its a large, my size). The auction was a Buy It Now one.

    I had accepted it as a bad purchase but then I saw mention of the Distance Seller Regulations on another auction, and how they apply to BIN auction.

    Can I return the Hoody under these regulations? The seller had a "No Returns Accepted" policy on the original auction. Does this preclude the regulations?

    If I can do I have to absorb the return postage costs?

    Any help within the 7 day cooling off period would be much appreciated!:) Thanks guys! It'd be great to get my money back on this thing ;)

    rules should be the same as a bricks and mortar shop afaik, they don't have to refund unless the item is defective in some way
    if they are ebay shops, some will take it back and refund less some sort of restocking cost (maybe 20%), but when you factor in postage costs as well, you're just as well to sell on adverts and put it down to experience

    If they are a business, and in the EU, then the regulations apply. Neither eBay nor Paypal will support you beyond the sellers terms though, so good luck getting anywhere with it.

    My hopes dashed :( Thanks anyway. I know for future reference to choose a seller with a returns policy.

    Distance Selling Regulations apply to business sellers. If the seller is a business, then the DSRs apply. Whether or not this (presumably) business seller actually follows them is another thing.

    If the seller isn't a business seller and had no returns accepted on the listing, then you agreed to those T&Cs when you agreed to buy the item. You could just sell it on, that would probably be the easiest option.

    Sell it to a mate, Or give it as a present.
    From past dealings like this it's to much hassle trying to send something back and get money back,, Also you have to pay postage back,

    Keep it, Sell to a mate, Give as a present ,
