retreving stolen goods

    hi i had a couple of things stolen from my house about 4 months ago november (ps3, cameras and laptops) and about 3 weeks later the garda caught the guy who did it 2 months went by and no word about our stuff so i started to ring them and find out what was goin on, after about 100 phone calls and 40 messages i finally managed to get talkin to the gard who was dealin with the case. tells me i will be gettin the stuff back in january, then nothing, ring him again he says case is in feb, again nothing ring him again and now he says it is gonna take more than 6 months to get this stuff back. he said if the items arent avaliable for the trial the guy will get off but at this stage i dont really care i just want my stuff back. is there any way i can get my stuff back sooner? i really cant wait a year to get this back!!!!

    My sister had her bag stolen in a club. The cops arrested the guy outside with it. That was nearly 3 years ago and she has not gotten in back yet.

    an injured party can't make a police property application.

    the property is an exhibit in an up coming trial. if it is not exhibited on the trial date and evidence of how it was preserved given, the case will fall and the suspect will be aquitted. to get around this, if the injured party really needs their property back, the garda can photograph all the property and then photograph the injured party with it and give it back prior to the trial. however this is not ideal at all and it can creates doubt over the evidence during the trial. unfortuanely the delay is caused by long court lists and waiting for a hearing date.

    Th OP did not say the case had not been dealt with so i assumed it was, if it is concluded then he proceeds as i suggested if he is having problems getting his property back.

    croc this was the bit that i reckoned that the trial hadn't happened yet and why i offer the opinion of the photograph. to me it appears that the case has been remanded the usual 3 or so times and now is set for hearing in 6 or so months. obviously im only guessing aswell!

    i think you have it right happy, its been up 2 or 3 times already. guess i have no option but to wait unless i can do the photo thing. pain in the ass if i knew i was never gettin the stuff back id just forget about it, but the fact its sitting in harcourt st doin nothing for the last 5 months just annoys me. how can the process possibly be that slow!!!

    try and stick with it iguanabob, i know it seems pointless now but imagine going to court and see the person who allegedly did this to you walk out the door laughing because the property wasn't available. trust me it will be worth it in the end. you are in the minority that at least you will get property back -most people, including myself last year, don't get it back (as in never recovered) and no one is ever caught. best of luck with it either way!!
