Assault Causing Harm

    Just looking at the English case of R v. Brown and Ors where a large group of men involved in rather hardcore S&M practices were convicted and imprisoned even though they had consented to the infliction of violence.
    Since this was upheld by the UK's appelant courts and the European courts, and even in a later case of R v. Emmet, would a case taken in Ireland on similar facts also lead to imprisonment, or would it just not be prosecuted? Or would the case be tried under the offence of Causing Serious Harm, which doesn't require consent?

    Don't worry, not looking to sort out my plans for next weekend, just looking at a few exam problem questions!
