Stolen Cheque, does anyone have any advice?

    Hi All

    A few months back I did some work for a Co. but never received payment, they were suppose to send me a cheque. When I contacted them they said they did issue me a cheque. They checked it out for me and have found that the cheque was cashed in AIB. But the cheque was crossed to me. I don't understand how it could have been cashed when it was crossed and the branch it was cashed in is over 100 miles away from where I live.

    Do anyone have any idea who is liable here, and what i need to do next.

    All your advice is muchly appreciated as I really need to get this sorted out!

    You have not been paid. If they report to the bank the cheque was stolen, it can be traced through the account it went through. IF it was crossed, then it is the bank that has to answer some questions.

    IF it wasn't crossed, then its still not your problem. You did not get it so they are liable.

    You cannot trace a cashed cheque. If it is crossed and has "account payee only" on it, then it can only be lodged to an account with the exact name on the cheque.

    The onus is on the employer to pay you, if the mail was compromised and the crossed cheque was cashed then someone has to answer somewhere. The employer should get onto his relationship manager. Saying "I sent the cheque, must have got lost" doesn't wash with the courts.

    Thanks both for your response.

    The cheque was definitely crossed; the co. have sent me a copy of the cashed cheque and it does say A/C payee only. It also shows the sort code of the AIB branch and the a/c no. it was cashed in. I'm going to the AIB branch a call tomorrow and see what is suggested from there.
