Events + Law Question

    Hello Everyone,

    I am a final year Event Management student and one of our courses is Event Risk Management/Law.
    Now this isnt a case of a bad lecturer but it is.....
    We have been given an assignment below however the lecturer that has given it to us is no longer teching us or part of the college I am in. Because of this we have been left high and dry in the final year of our degree.
    Law isnt my strongest subject however I find it extremely interesting and extermely important to have a knowledge of in order to work in the field.

    Would there be any chance anyone on this site could shed some light on anything in the assignment below as I am despreate for some direction. This is not a "do my assignment" post.

    Assignment

    The objective of the assignment is to assess the student’s ability to apply legal theory to a practical problem, support that theoretical application through the use of case law, and come up with a reasonable conclusion, together with appropriate remedies.

    ABC Limited is an events management company which has organised a concert in the local area and has sold tickets to members of the public. ABC Limited has entered into a contract with a local band to play at the concert and has agreed with the band that they will begin to play at 7.00 pm on the night of the concert. ABC Limited plan to erect a marquee in the grounds which will house food and alcoholic beverage stalls. ABC Limited plan to provide a car park at an additional cost to the concert ticket. ABC Limited erects a sign on a tree inside the car park stating that ‘The events organisers will accept no liability for any loss or damage to any vehicle parked in the car park howsoever caused.

    A. The marquee is erected on rough ground. This makes it difficult for concert goers to walk on the surface of the marquee and a woman, Sarah, trips on the rough ground and suffers injury to her leg.

    B. Two men arrive at the entrance to the concert. They appear to be drunk and are not in possession of concert tickets. They attempt to gain entry to the concert and when the security staff, employed by ABC Limited, prevent them from doing so a scuffle ensues. One of the men suffers an injury to his arm.

    C. John, a concert goer, parks his car in the car park. When he returns to the car park after the concert his car has been damaged, apparently by another car hitting it.

    D. The lead singer of the band requested that ABC Ltd provide an elephant for him to sit on as part of his grand entrance for the band’s first song. During feeding, the elephant escaped and caused significant traffic obstructions and damage to cars parked outside the venue.
    E. The band does not turn up.

    In this regard, advise ABC Limited on the following:

    A. Any liability they may have to Sarah.


    B. Any liability they may have to the man injured while attempting to gain entry

    C. Any liability they may have to John.

    D. Any remedies that may be available to them against the band.

    E. The nature of the various licenses they may require in order to sell alcohol on the concert premises.

    F. Advise ABC Ltd on whether they have any liability to the concert goers in respect of the non-appearance of the band.

    G. The nature of their liability for the damage caused to the nearby cars by the escaped elephant, and any liability for the traffic obstruction.

    Hi Andy,

    The way were told to answer problem questions like this in my college is using a method called IRAC.

    that is:

    I - Issues - describe the outstanding issues in the question

    R - Relevant law - describe the law that is relevant to the questions, eg, any legislation or case law which relates to the issues in the question.

    A - Application - Apply the relevant law to the issues of your scenario and describe the possible outcomes!

    C - Conclusion.

    Hope this helps a bit.

    Thanks for the reply! Thats how I planned to answer the question but its good to hear someone is on the same path.

    Another quick question:

    Is there an online data base of Irish legal cases so I can find similar cases to apply or how do I find these laws ect?
