Stolen from Gym

    Hi Guys

    Recently my Ipod was stolen from my locker at the Gym I attend. The locker was locked, and the thief's broke the locker and not the lock itself. The two men were on a tour of the gym fatalities at the time, and while looking in the dressing rooms they robbed two lockers. Do i have any case for a compensation even if the gym has a sign saying "lost or damaged property at own risk" the gym say I don't but I don't think this is very fair seeing as the two guys were let in, and it was the quality of their lockers and practices that were to blame?

    Sounds like the gym has bigger problems than stolen iPods.

    But the disclaimer would most likely apply to your circumstances. It doesn't say "lost or damaged property [by our own members] at your own risk". Best option may be to give out yards to the gym, threaten to cancel your membership, and see if 1. you get any minor compensation, or 2. makes them re-think security of their lockers.

    Sorry OP - the law operates very strongly against you. Once you are put on notice of disclaimed liability for stolen property etc, you have nothing to rely on in the law. As poster above says, talk to the gym and see if they are willing to make some form of gesture.

    That's what I was expecting. The have offered me a months free membership as a good will gesture so that's something i guess. They are also reviewing their methods and upgrading their lockers so at least some positives are coming out of it. I will probably write to them with a nicely worded letter and maybe they will fire a more substantial goodwill gesture back at me.

    I'd take it to the small claims court, irrespective of any disclaimers. It will cost you 15 euro to take the case (at least it used to be 15 euro anyway). The small claims court has no jurisdiction to award costs so if you lose you can't be made liable for the costs of the gym. You don't need a solicitor, you can do it yourself. The gym will probably just give you the price of the ipod to avoid the hassle, it would cost them more to defend it than to give you the price of a new ipod. That's my advice. Worst case scenario is you lose a small claims case with no order for costs against you.
