Gas fires in DEAP

I am assessing a 2002 duplex and it has an open fronted gas fire fixed in the fire place (fixed in place).

I assume it would have to have a flue coming out of it which would have to be sealed to the chimney or fill the full fireplace (sealed all around) to be categorised as options 2 or 3 below. It doesn't do either, there is a 60 / 70mm gap between gap between the top of the fire insert and the top of the fire opening.

It seems very low for such a modern fire. The fire insert itself shields most of the flame from the chimney so I can't imagine anything like the as much heat would be lost up the chimney as a 30% efficient open fire. 20% efficient seems harsh but i assume it it correct.

I would be grateful if anyone confirm or correct me here?

    DEAP options -

    (1) Flush fitting Live Fuel Effect gas fire (open fronted), sealed to fireplace
    opening 40%

    (2) Flush fitting Live Fuel Effect gas fire (open fronted), fan assisted, sealed to fireplace opening 45%

    (3) Decorative Fuel Effect gas fire, open to chimney 20%

you answer the question yourself in your post...

the fireplace isnt sealed therefore only (3) can be applied

I would go with 3 also.

BTW I have one in my house and there is nearly no heat from it. I will be removing it soon and installing a stove.
