Montessori teacher left. Constructive dismissal??

    Hi,
    Our son's montessori teacher left her job of 5 yrs after owner started dumping whole new class in on top of her class. Other kids wrecking her classroom, disrupting the class. She is gone a week almost.

    Owners words were something like, "Lump it or leave it!"

    Now teacher is upset, and my wife is upset. Seems all the other parents are confused as to what to do. The children are attached to her and don't understand where she is gone? There is a bond between her and the children which I hate to see broken.

    I believe this could be case for constructive dismissal. Since her resignation, the owner has dropped the price increase planned for this year.


    Any ideas?

    It's impossible to say without reading her contract. It's possible there is a clause which states she may have to deal with classes of different sizes, or something like that.

    How is it constructive dismissal?

    Classes get moved around, teachers leave. It happens. You can't save the kids from that. Its part of life.

    Without knowing the details, an employer can be deemed to have constructively dismissed someone if they deliberately make working conditions so unbearable for the employee that the employee will leave of their own accord.

    Why were two classes joined. Did it happen to any other classes. What happened the other teacher. Is the class size still doubled?

    As far as I know there are fairly strict ratio's for pre school aged children, I thought it was 10 children to 1 adult for 3 and 4 year olds who were in sessional care, if they went over these ratio's she could have some type of a case.
