Inheritance query - CAT

    I have been mentioned in my grandmother's will. I received a letter from the solicitor notifying me of this. Along with the letter there was a form to be filled in asking if I had received any gifts / inheritance from any disponer. Is this correct to ask for this information? I don't see what my financial history has to do with my grandmother's will. I do not want to disclose this information as the executor's will have access to the file. Am I wrong? My understanding would be that everyone is responsible for their own tax affairs. The letter mentions that this form is needed in relation to CAT but surely I will be responsible for paying my own CAT once the will has been settled as will all other beneficiaries??

    This is not legal advice. The executor is secondarily liable for CAT. If you do not pay, the Revenue may pursue him for it. Because CAT is cumulative, previous gifts may affect your liability to CAT. A prudent executor will get a CAT clearance cert for himself before releasing funds from the estate. You do not need to tell the executor what gifts you have previously received but you will have to tell the Revenue before they will issue the clearance.

    Taxation/Legal advice should not be sought on this forum. If someone here got it wrong and you ended up owing the revenue a fortune, you might chase boards.ie for publishing the wrong advice.
