Change of ownership - Written off Vehicle

    Hi

    I hope someone can give me good advice here.

    My car was flooded last summer & written off. The insurers - Quinn Direct issued a cheque direct to my garage, they took the car & logbook& gave me a brand new one. Happy days, case closed ! untill......

    I started to receive EFlow notices for the registration number. So I was contacting Eflow & telling them the same story repeatedly. When they got their act together & were eventually able to issue photographic evidence sure enough, there she was going down the M50. So I contacted Quinn & they advised the car was sold on for salvage. They told me to send in the notices & they will contact the salvage company, the salvage company will see where it was sold onto to & pass them on. I wasnt happy with the answer so I questioned it more. I have never so much as received a letter from Quinn saying your claim is now processed, heres your cheque, your claim number is etc etc. I have absolutely no proof off them that a claim was ever made.( well apart from the fact I have 3 registered vehicles in the last year which im sure looks strange)

    Now today I received a fixed charge parking fine from the Garda for this car I no longer own.

    Has anyone any idea what I do or where do I even start?


    ( I did at the time question with Quinn C.O.O but they told me no sale was involved & there was no owner as the car was being written off)

    I would start with the garage, get soemthing in writing from them as to when they took possesion and ownership of your car.

    Its a strange one - The only reason the car was at the garage was I wanted an independent assessement because originally Quinn just wanted the car dried out & me on my merry way. The car was just held there as such for Quinn to do their assessemnt & until the collected it. Supposedly according to Quinn today they know which salvage company it went to......... The garda called me back & said I need to get an affidavit & the tax office said all I can do is do a disposal on it which is only effective from the day its processed meaning im still liable for all the current fines.

    I would definitely be contesting that. My position would be that my responsibility ended when I accepted the insurance settlement and handed over the registration document. The new owner of the car is liable from the date they sign the transfer of ownership part of the reg form.
