How to get your money of a solicitor??

    Hi all,
    My court case has been settled in December and my solicitor has the cheque! He told me he posted cheques to the witness three weeks ago...yet they haven't received them!! He also told me my cheque was in the post and when i rang up he mentioned something bout a small robbery in the bank even though my cheque was suppose to be in the post. Bad solicitor choice but got stuck with him and can't get money sorted now. Can any one help?

    Could you arrange to go in and collect it?

    i live 150 miles away unfortunately!! have arranged for a family member to collect my cheque but the witnesses have not got theirs and they keep getting on to me to sort it out even though i don't have it to give them!!

    I would suggest contacting your solicitor and advising them to cancel the previous cheque, as it had not been received.

    Also request that a new cheque be sent by Express Post (signature on deliery and traceable in Ireland). Get the tracking number and give it to whoever is waiting on the cheque.

    Yes it is very annoying as the solicitor just won't work with me, ignoring phonecalls and stuff!. The case should have lasted 3 years max and went on for 7!!! i've grey hair now. I thought my troubles were over now but obviously not. May there is somewhere i could complain as i wouldn't like any one else to go through the same! Thanks for the advice though. I'll try and get in contact with him to ask to get the cheque tracked

    Write to the Complaints And Client Relations Section, Law Society, Blackhall Place, Dublin 7. Advise them as to what is happening.

    Talk to you Solicitor. Did he actually say he had received it and it was in the post on the way to you (maybe he was informed by insurance company that the cheque was in the post on the way to him...) But if he does have the cheque, it would be made payable to you and there should be no delay in sending out the cheque to you. I wouldnt contact the Law Society just yet. Getting your cheque in 2 / 3 months is not too bad. I know some insurance companies where its nearly 6 months before settlement cheques are sent out! Anyway like I said, the cheque would be made payable to you and the Solicitor would have nothing to gain by holding in to the cheque.

    In relation to the witnesses, your Solicitor requested them to attend, not you. Either ignore their calls or tell them to contact your Solicitor. Its a matter that is out of your hands.

    Out of interest, whats the comment about a small robbery in the bank about???
