Help!!! Really need answer......am lost

    Hi,

    I hope someone out there can help. My dad passed away December 29, 2008. He had no property, assets, nothing to probate. However, he did have a car....but also a loan with that car. We have been unable to find a will as of yet, but my brother (my only other sibling) is the executer of his estate. We want to be able to keep his car and my brother is willing to pay the monthly car payment. Can he do this without having to get the loan in his name? Neither of us can qualify for a loan right now. He did not have the credit insurance on the car loan.
