Used car which has no Tax

    Hi guys,

    I just bought yesterday a used car, which the last tax disk displayed was about 2007. Now I don't know how to proceed, should I wait for the log book and then tax the car? Can I go anyway to the tax office and tax the car even if I didn't receive yet the new log book with my name in? the car is 2000 model and I don't know if should I sign any forms.

    I really appreciate your help coz Im using the car anyway and I don't want that my car would be seized by the cops.

    The tax office needs to know what the first day of (your) ownership is. This will be on the cert from Shannon.

    Ok but for example, what would happen if the seller forget to send the cert to Shannon and he takes 15 days to send it? wouldn't be able to road the car then????

    This says selling but the part in bold should apply to you too I think. Maybe someone else can clear things up. The Gardas usually give you a grace period if they stop you but this is not written in stone.

    If you sell your vehicle privately, part B of the Vehicle Licensing Certificate, which you would have received when you bought the vehicle, should be completed and returned to the Vehicle Registration Unit (see Where to apply). It usually takes about 3-4 weeks for the registration in your name to take place. You cannot tax your vehicle in your Motor Tax Office until this has gone through. As failure to drive without paying motor tax is an offence, you should not drive until you receive confirmation that the change of registration has occurred.

    This is why I still drive my old car while waiting for papers for my new car, it's all about overlapping.

    Just saw a thread here about a guy losing his car because it had not tax. Might not happen to you but don't temp fate by driving without tax.

    Yes Bico I know, but in my case I just bought the car and this guy just drive without tax which is different, I mean, both has no tax, but in my case there is nothing that I can do till the log book comes to my post.

    A guy at work is saying that if I show to the garda a prove that I bought the car some days ago, that's it.

    If you show a Garda a genuine transfer of ownership receipt then they will most likely let you on your way. They don't have to though, as the letter of the law allows them to take the car off you.

    Get on to the guy that sold you the car and see if he's sent the forms off yet. If he hasn't you can tax it while the car is still registered to him before he sends the forms off (just get a Garda to sign the declaration section where it says the car has been off the road for X months so you don't have to back-tax it).

    I was in this same situation, went into tax office and they gave me the form and stamped it with a date and their details on it. Told me if stopped it wouldn't mean it was ok to drive but most guards would be fine with that as its shown i did try to insure it. Was insured properly and all that, was a small risk i'd get a thick garda pulling me over but didn't happen. Ownership form arrived shortly thereafter and i taxed her up.

    That's what i'd try if i was you

    It's chancey. As said, there is no stopping them taking the car off you.

    I'd be filling out this correctly, and having it in the glove box a long with any receipts you have of the car etc. etc. Just have as much proof as you can.

    Thanks top dog, but in the case that he already sent the form, and the garda stops me, with the receipt would be enough? and if he sent the form, I dont need to go to the garda station to fill the form saying that the car has been of the road?

    we have no receipt section on the logbook for transfer of ownership in ireland. would be handy if there was a little tear away section for the new owner to keep on hand until the revised log book comes from shannon. the best thing you can do is copy the log book just before you post if possible, if not then just wait for the new log book and tax the car from the day you bought it.

    i dont know of any other way of prooving you only bought it unless you bought it from a dealer in which case you would have a receipt from the dealers.

    Like I said, its highly unlikely that a garda would take the car off you. They'd want to be in one foul mood, or you'd want to have done something fairly stupid for them to actually sieze the car. ;)

    Doesn't the RF105 or whatever form still exist? Last time I bought a car was 12 months ago but I was still able to fill that in and have the reciept in the tax disc holder until I got the logbook back from Shannon and could tax the car.
