Getting caught for speeding?

Ok I was driving outside my local town at night and was doing 80-100 kmph in a 50 kmph zone, shouldn't have been doing those speeds, you know the temptation of an open road etc etc but was stupid when coming out of a fairly busy town.

Anyway looked in my rear view mirrors and the flashing blue lights came on, so I pulled over and got finger wagged by the guard, asked why I was doing those speeds and was I drinking and had a look at my tax, insurance and licence etc

There was 3 in the car, they weren't doing speed checks just tailed me and saw I was going too fast.

They left me off anyway just wondering can they do you for speeding when they don't have the speed gun out? I presume they could have done me for dangerous driving in this situation instead...

I think it takes 2 Gardai to do you by tailing you in a squad car.

He prob knew you were speeding but thought he didn't have enough evidence to do you for it so gave you a warning.

Fair enough got lucky so must watch it!! thanks

It might have nothing to do with with not having enough evidence. You can't rule out the possibility that the Garda was just reasonable and saw that you are a decent fella, could let you off with a warning and know you'd learn your lesson and everyone wins.

  • Registered Users, Registered Users 2 Posts: 26,154 ✭✭✭✭Berty

The Gardai have the discretion to give you a tongue wagging instead of a fixed penalty fine.

True enuf, tbh he was dead right gave me a lecture about how someone drunk could step out on the road at that time of night etc., won't be going those speeds there again so I've learned my lesson

    Thanks

Thats a bit harsh yeah the OP was an idiot but to say banned from driving, he got caught he was lucky because technically double the speed is a banning or could be if the gaurd wanted.

He aint going to get alot of sympathy here for speeding he was just wondering did he get points.

Yeah he will know what harsh is i agree, but he didn't he got stopped, so lets hope he learnt his lesson, unlike so many people who speed he areas who dangerously tailgate dangerously overtake in a residential area.

Some 50KPh zones are stupid and you can notice yourself putting the foot down abit when there is no houses around its an empty road but the speed limit is low.

We all speed sometimes some more then others but hoping he gets banned from driving for once being over the speed limit is silly, and coming across a little grumpy

yes, I do speed on the odd occasion, but it's more like 60 in a 50 zone, 90 in an 80 and so on but no more than 10 kmph over the speed limit, I have NEVER driven at almost twice the speed limit (except the time when I had to rush someone to hospital!!!) and I have been driving for over 20 years.. and never once had an endorsement on my drivers licence...

Why? You don't know where he was caught speeding. Was there a legitimate reason for the low limit on what the OP claimed was a straight stretch 'outside' of town?
Many places have an incredibly low speed limit for unknown reasons.
I would be inclined to think that this was one of them and that the gardai saw this also!
    CamperMan wrote: »

Exceeding the speed limit does not automatically mean that you will crash. Conversely, driving under the speed limit does not mean that it will not happen!

So you do speed - let he who is without sin...

Anyhow, IMO you are trolling and I'm tempted to give you a free ban should I see you continue at it!

kbannon... the reason for my posting was that several years ago, I saw a young mother pushing her pram across a road only for a young, inexperienced driver speeding, went straight into the pram killing the toddler in it.. it was very upsetting... hope you don't ban me for putting this up....

Something like that happened to me a few year back when I was driving out of Rathcormac one night. A woman, dressed completely in black staggered out across the road in front of me, she came out of nowhere. Thankfully, I stopped in time, don't ask me how. If I'd hit her, she was a goner (and yes, I was driving under the speed limit).

I only mention it just in case anyone thinks something like that would never happen.

Oh get off your high horse, the OP has seen the wrongs of his ways, learnt his lesson, he won't be doing it again. There's always one...

  • Closed Accounts Posts: 1,563 ✭✭✭segaBOY

CamperMan I've learned my lesson and have been religiously abiding by the limits since then

Never been pulled before for anything and hope not to again

Not defending it but it was a straight wide stretch of road where it goes from 50 to 60 kmph until it goes to the 100kmph limit, it was outside the main town but still in the lower limit zone, there was noone walking and noone else on the road besides that squad car-if you want me to be banned for putting the foot down on a wide straight empty road then half the country would be without a licence

As said it was stupid and I've learned my lesson and thanks to the guard involved for showing a bit of leniency-it was very kind of him imo

    +1
Came across a drunk teenager lying in the middle of a rural cross roard about a year ago, thank god I spotted him...for the record he got up laughing and walked away, lucky I wasn't going too fast and spotted the guy in time

Fair Play thats what driving is about, learning form your mistakes.
But can i ask what did the guard ask you? Because the few times( which were few and far between) that ive been driving or in a car which has been pulled due to speeding, the first thing the Guard has asked was " Were you Speeding" which is usually a stupid question as everyone involved knows you were but if you reply "yes" they feel within their power and often obliged to give you a ticket. If you say no i didnt think so they usually tell you u were and give you a slap on the wrist. My experience is that if you fight everything tooth and nail they usually let u off without a fixed penalty. However this is just my experience.

OP - If I were you, i'd be as concerned about my observation skills as about the speeding. A Garda car behind you should be kind of hard to miss. Just my 2c.

    Unmarked Car maybe?

Even an unmarked Garda car (excluding specialist units) should be hard to miss. Especially if you're considering doing 80-100 in a 50 zone.

I agree with this in daylight, but the OP did mention that it was at night, so he would have just been able to see two headlights until the blue ones came on

Maybe i'm just paranoid, but when i'm thinking of really going for it I assume every car is a Garda car until I can see different. As any good crim will tell you, observation is everything when you're breaking the law.

Absolutely, but night-time (especially outside of urban/lit streets) does make it harder to spot unmarked Garda cars, and means that one holds back in situations where you cannot be sure. I know guys who don't dip their rear-view mirrors, as it makes it hard to see who is behind (they're not crims, they just don't want to do the wrong thing with a Garda car behind them!)

OP, the worst to expect is 2 points I would say. I was pulled over by a single garda and got 2 points (I was lucky cause I was going nearly 2 and a half times the speed limit - motorway driving).

With reference to seeing an unmarked car, i tend to look forward more so, then staring in my rearview mirror trying to figure out what the car behind me is.

Now, let me get this right. If the motorway speed limit is 120km/h, you think you were doing 300km/h?

I say fair play, but part of me wonders why you stopped, unless the Guard got out of a helicopter.

I don't mean to sound smart, but it's not an either/or thing - you should be looking all around you, all the time.
