Redundancy and time off for interviews

    Hi , Have just been told company closing March 31st , Boss is saying we can have time off for interviews but will have to work up time , would this be correct as we are being made redundant . Thanks in advance for replies .

    If you are being made redundant, you are entitled to reasonable paid time off in order to look for a new job. This right is set down in law in Ireland in Section 7 of the Redundancy Payments Act, 1979. (You should note that while the Redundancy Acts have been amended a number of times the provisions as set down in 1979 for time off, still remain in force today.)

    The act that is linked to says you need to be there 104 weeks at least.

    The query the individual made was about working up time, the last thing they need is a smart comment. If you have nothing good to say, don't say anything.

    FFS, I immediately edited my post, because I didn't realise initially that there were specific provisions in place for this scenario so I went and got the specific legislation and posted it to support the OP's position.

    hey mod i wouldnt bother with this one seems like they just out for good aul trolling.. plus OP is num_one and then another pstoer called num_bum comes along with 1 post?? strange indeed....

    If you have a lot of hoiday pay and pension pay which the boss can use as a lever to ensure you conform with the rules then you have no choice but to do what your told.
    It is well within the bounds of possibility that any shortfalls in time worked will be docked from any payouts of redundancy and pension and holiday pay owed.
    If you have the need to attend interviews you will probably have to take holidays or work up the time as requested.
    The possibility is also that you will need to be on the good side of your boss to ensure a good reference if it is the company policy to issue references. Some companies no longer issue official references beyond a sparse account of years worked and start and stop dates. But other companies allow a full detailed account of the attitudes, diligence loyalty etc of employees and if these are found wanting.............
    On the other hand those companies depending on the future goodwill of their remaining staff to stay operational tend to be more leniant with time off for interviews etc. They don't want to piss off the remaining staff.
    It all depends on what levers of power each side has and if a company is closing completely the boss has nothing to lose or gain from being kind to staff.
    Often decisions of money and payroll will be in the hands of creditors such as banks etc and every cent will be watched vigilantly.
    Anger and recriminations at this time, although the most natural thing in the world, will only compound things and make them worse.

    It's only in the last couple of weeks that the employer has to pay according to the Redundancy Payments Act, 1979.
    (2) An employee to whom this section applies shall be entitled during the two weeks ending on the expiration of his notice of dismissal to be allowed by his employer reasonable time off during the employee's working hours in order to look for new employment or make arrangements for training for future employment.

    (3) An employee who is allowed time off under this section shall be entitled to be paid remuneration by his employer for the period of absence at the appropriate hourly rate obtaining on the date of his notice of dismissal and to remuneration equal to this amount in a case where the employer unreasonably refuses time off under this section.

    (4) The employer of an employee to whom this section applies may require the employee to furnish him with such evidence as he requests of arrangements made by the employee relating to effort to obtain new employment or training for future employment, and the employee shall furnish any evidence so requested if it is not prejudicial to the employee's interest.

    Christ! what sort of a git is ur boss? Im mean ur being made redundant and the @*** wont give you time to look for a job??? If ur not getting a package out of it I'd certainly tell him where to stick his stupid job. How UNCARING! Obviously his job is secure then :mad:
