No, they send it back with the corners cut off, but I don't think you can use it to travel with. Can you get the US embassy to issue a visa in the new passport?

No you will get it back, but the sides will be clipped and expired stamped all over it. Would the visa be valid in an expired passport though?

US Immigration will more than likely refuse the visa, irrespective of it's actual expiration date, on the basis that the passport is out of date/invalid.

Quick question; are you an Irish passport holder? Do you actually need the US travel visa?

long story short, yes i need the travel visa. i was informed by us customs/embassy (cant remember who i asked, but it was official) and they said i'd be fine with the visa in my expired passport as long as i had my new passport with me.

..or are they wrong? i'll be travelling in march, i really dont want to have to go through the process of getting another visa.

You should try to get that in writing from the embassy, or better yet, email Homeland Security/Customs and Immigration.

I'd double-check with the US Embassy in Dublin. I wouldn't rely on any other source, as they can be extremely sticky, and you need a official information.

At least you've a good bit of time to ascertain exactly what you need - although it wouldn't surprise me to hear that the expiry date of the passport renders the visa invalid. Also, the passport number and the visa are probably linked, so they wouldn't be any longer once you're travelling on the new passport.

As I said, this is just all opinion, so my advice would be to contact the US Embassy directly and if possible, get something in writing from them.

I called the US visa helpline ( at effing 2.40 a minute) and yes, i can travel with the visa in my expired passport along with my new passport, as long as the visa is not damaged in any way.

I then called the passport office who told me that they will send the passport back if needed, and they are not permitted to touch the visa, only clip the corner of the passport page and stamp it expired.

Get it in writing. Some of the US Immigration employees are brain dead. My mate was going into the US once and was asked for his passport. He offered both his Irish and British passports and was asked "How come you have two passports? That's illegal!".
