A man who took part in a violent attack on a garda who was trying to arrest his cousin has been given community work instead of a prison sentence.

His then 15-year-old friend who was seen kicking another garda on the ground has had his sentence adjourned at Dublin Circuit Criminal Court.

Declan Teeling (aged 21) and John Dunne (aged 18) both of Coultry Road, Ballymun, were part of a group that took part in a assault on Garda David McCarthy and Garda Ian Coyne after they tried to arrest Dean Teeling. The group had been drinking on Coultry Road.

Judge Katherine Delahunt sentenced Teeling to 240 hours community service to be completed within 12 months or face two years in prison. She adjourned Dunne's sentence until March to allow for preparation of a probation report.

They had pleaded guilty to assaulting the gardaí causing them harm on June 1, 2006.

Teeling later admitted the assault with the words: "I battered them and I don't give 'rats'. I'll gladly take a charge sheet on that. No further questions."

Garda Sergeant Edward Carroll told prosecuting counsel, Ms Marie Torrens BL, that Dunne was arrested at home the next day and also admitted his role.

Kelly Boyd (aged 21), a mother of two, of Marewood Crescent, Ballymun, received an 18-month suspended sentence last December after she also pleaded guilty to assaulting the garda.

Dean Teeling of Oldtown Road, Santry, received a six-year sentence from Judge Delahunt for the assault and a series of robberies in 2006.

He had pleaded guilty to assault causing harm to Gda Coyne, to obstructing a garda during in the execution of his duties and assaulting Gda McCarthy at Coultry Road.

Judge Delahunt imposed consecutive sentences totalling six-and-a-half years and suspended the final three years, telling him she was taking a chance on him and warned if he stepped out of line he would be back before her.

So he 'battered them, and don't give rats' and for that he gets community service? Why doesn't someone give him a hug, and tell him it is not his fault the system failed him? Then someone might explain to those Gardai how the system failed them.

I think the Judge got the ruling the wrong way around!

He should have gotten 2 years in jail then when he got out told to do 240 hours of community service.

    That ruling is a farse!

No wonder there are so many scumbags out there with rulings like that!

Delahunt is not known for being tough on criminals. All bark, no bite

Wow... I mean that annoys me... I can't imagine how pissed off a Garda must get at micky mouse sentences such as these.
