Can you legally rip and use a ROM from your own DS carts

    I heard it is illegal to download ready ripped roms but it might be legal to rip your own and use them. Is this true?

    A mates kid has 40+ games, it is a lot of moneys worth to be lugging around for a 5 year old, which he could lose or have stolen, it is also much handier to have them all on a single menu.

    Why would anyone, including a 5 year old want to carry every single game around with them? Regardless of how handy it would or wouldnt be doesnt make it legal LOL.

    Its a gray area but it is legal to make a digital backup copy of any game, music or video you purchase ( unless the manufacturer states other wise )... it becomes illegal when you distribute them to others ( aka piracy ) or download them from others

    @ CutzEr - I'm not sure how its done with NDS but with the likes of PC, 360, PS3, music and videos its as simple as copying a folder but ill leave it at that as this ain't the forum for discussion of such matters

    I'd be very wary about this assertion, Where did you get your information Flacks? To the best of my knowledge you aren't entitled to make "backups". As far as copyright law is concerned a copy is a copy regardless of its intended use and its illegal.

    I also believe that its the copying of copyrighted material that is the act of piracy (ie copyright theft) not the distribution of such material.

    IIFC, it WAS legal to make a back-up of software you purchased, but the law in Ireland changed about 6 years ago with little fanfare.

    Considering they are selling Ds homebrew cards in Cartridge World in Cork City i don't think the guards will be knocking your door down for making legitimate back ups

    Homebrew and the R4 carts used for it aren't illegal. using them for copyrighted material is.

    Whether the guards or Nintendo's lawyers are likely to get involved or not isn't really the issue, its still illegal. If people are going copy games, movies or whatever they shouldn't be under the illusion that what they are doing is within the law.

    I thought I read somewhere that the actual cards contain some copyrighted Nintendo protocol that meant even with homebrew they weren't technically legal.

    There is a card by I-cheat, called the icheat pro or superduper or plus or something which allows the running of homebrew but not commercial ROMS, they used to advertise them in N-Revolution when the Mag still existed. I never got one though, so not sure what they were like.

    I dont know how aggresively ALL the other card makers would be pursued though. If they started selling them with Commercial ROMS on board I think thats when the authorities would start cracking down.
