redundancies in company, and now we're up for sale

    Hi

    I work in a factory that is amercian owned, they are looking for some voluntary redundancies at the mo with a package of 6.5wks, I wasn't going to volunteer as I am only with the company 3 years but it was announced last week that the amercian co. are now selling us as well. If the new company decide to make me redundant when they take over would I only get the statury 2 weeks? i have being trying to reseach TUPE rights where the new company would have to offer the same T&Cs but not getting much information. Are amercian companies covered by TUPE? Even though I had decided not to apply for the voluntary the 6.5weeks would be worth over €12,000 to me so really starting to panic. There is no union in the factory. Any advise would be appreciated

    What is TUPE? Ah - S.I. No. 131/2003 — European Communities (Protection of Employees on Transfer of Undertakings) Regulations 2003 www.irishstatutebook.ie/2003/en/si/0131.html

    It applies to everyone, more or less. You are entitled to the same benefits whether you belong to a union or not - its just that unions have experience at this kind of things.

    No harm in talking to a union or solicitor to represent all the staff.

    While I dont have experience with US companies (only European and Asian) as far as I'm aware your rights would be protected as the company is based in this country and your contracted concluded according to Irish law. You should really talk to an employment law specialist. A brief consultation wouldn't cost you very much and it would give you a definitive answer as to your rights and entitlements.

    For what it's worth 6.5 weeks is a very offer in this climate.
