    Hello,

    I'm hoping someone may be able to help me with what has become a problem in my job.

    Firstly, I'm an EU citzen who moved to ireland over 6 years ago and have been working since, paying my taxes etc. Almost 1 year ago I changed jobs and unlike my past jobs, my current employer is not paying for bank holdiays although I do get paid for some (not all) my holidays.

    I have spoken to someone in NERA (National Employment Right Authority) but an offical complaint is required. They have told me all the offical rules but when I asked my employer about why I was'nt paid for bank holidays in the past, I was told that its minimum wage and bank holidays are'nt included. NERA told me this was untrue but I wanted to ask, how should I deal wtih this ? I fear that my boss will cut my hours or make work unbearable if I was too make a complaint.

    firstly how many hours per week do you work? you have to work a minimun 40 hours in the 5 weeks preceeding a bank holiday to recieve any entitlement.

    Also your hours work affect your holiday pay, in effect if you work a set numbers of hours per week,every week for a minimum 6 months you will get holiday pay roughly equivalent to that amount of hours.

    as for your employer explanation about minimum wage all in all it sounds well dodgy,make the offical complaint your losing out.

    Holidays are Payable at 8% of hours worked up to a maximium of 20 days per annum. Minimum paid employees are entitled to Bank Holidays.

    When you have worked over a year you will be covered by the unfair dismissal and minimum notice. So if you are worried about being let go don't rock the boat until you are there a year

    If the boss did cut hours or give her the sh1t jobs, would constructive dismissal be an option?

    Everything I don't like is either woke or fascist - possibly both - pick one.

    If your not covered by unfair dismissals it doesn't matter. How many lovey minimum paid jobs are there?
