Brown Bin Robbery

I had my brown bin collected today, they only emptied 25% of it and are charging for a full collection. Phoned Dublin City Council who say that it is our responsibility to ensure that the waste is loose in the bin for collection and that we will have to put it out again and be charged again for this service. I informed them that the design of the bin was such that with freezing temps overnight the waste has frozen into the perforations in the bin and there is no way that I can ensure for this situation. In light of this I requested them to recollect free of charge as the issue is with the bin design and not me, they refused citing that they investigated and researched the bins and found these to be the best option. I know in Galway the brown bin is the same size as the black bin and has no perforations and no issues so Dublin City Council obviously didn't do enough home work. When I said I would refuse to use the brown bin anymore I was told that I would be breaking the law, which law? The dept of the Environment don't seem to have a law in place with regard to this.
