Hey, does anyone know what happens when you forget to pay a toll? Went through the M50 one there 2 days ago, should have paid by 8 last night but totally forgot. What should I do?

These links should answer your question.

    http://eflow.ie/payment/index.htm
If you miss the deadline (8:00 PM), you will receive your bill in the post and are liable to further charges for late payment.
    http://eflow.ie/tolls/index.htm
For unregistered users, if you don't pay your toll before 8pm on the day following your journey, a penalty of €3 is added to the outstanding amount.
If you fail to pay the toll and this €3 penalty within the next 14 days, a further penalty of €40 will be levied.
Failure to pay the full amount due within a further 56 days will result in an additional €100 penalty. Then if you still have not paid the total amount due, legal proceedings will be initiated.

I also recently went through the toll and forgot about paying that evening. I went on hols the day after so it was 13 days or so before I thought of it again.

I went online to the web site and tried to pay - the site advised that because it wasn't today or yesterday, because I hadn't yet received a notice AND because I was late paying that I had to ring the 1890 number. I rang the number THREE times and tried all the various menu options but nothing seemed to work and eventually I gave up.

I submitted an online query in the hope they might email me but so far nothing (six days later).

I have been back onto the 1890 number today (now 19 days after passing through the toll) but still can't speak to an agent. I've left my details on their automated system but I hold no hope in them contacting me or helping me out.

    What a joke!!!!!

Ive missed it about 10 times now, when you forget to pay you get a letter a few days later to the owner of the cars address. The letter states you owe them the €3 plus €3 fine. If you dont pay that (online or otherwise) within 14 days the fine goes up to €3 plus €47~. I got stung for over €100 during the break, my own fault. I keep thinking if I dont pay maybe they wont send the letter and I'll get a free trip! Hasnt paid off so far! :o

How do they come up with these mental penalties? Under what law or contract can they charge €147 on a €3 debt? People are mad if they pay these.

 Your life is now forfeit. Hope you had a good run up until now. :(

(on a more serious note it is more than slightly retarded how the system of fines works)

Does it have any basis in law? Where do you agree to pay €147 if you forget to pay €3 when using the Toll? How are these fines enforceable?

Its the new cashless "credit" system imposed by the authorities to extort excessive revenue though confusion and genuine forgetfulness. Under the old honest cash system one would rarely if ever approach the toll plaza without payment.

I missed my turn-off on the M50 three days ago so had to go through the toll twice to go back the way I came. Forgot to pay but haven't recieved a letter yet and can't pay without the penalty code. If you don't get the letter, can they still impose a fine later on?

A legal basis is highly likely but I couldn't find it explicitly stated anywhere. The most relevant act I could find is the Local Government (Toll Roads) Act, 1979

Section 2 : Allows a road authority to decide level of tolls by means of a bye-law.
    (1) Subject to the provisions of this Act, a road authority may charge and collect tolls of such amounts as may be specified for the time being in bye-laws made by it under section 5 of this Act in respect of the use of a toll road.
    (3) Where an agreement under section 9 of this Act provides for the collection of tolls by a person specified in the agreement, that person and his servants and agents may collect the tolls to which the agreement relates"
    Section 7
    (1) A person who is liable to pay a toll and who fails, neglects or refuses to pay the toll shall be guilty of an offence
Section 9 : Allows a road authority to enter an agreement with another person allowing them collect and retain all or part of a toll.

This is how I see it (only my opinion):
Based on the above Act, the road authority (aka council) declares a bye-law for the toll then contracts a company to operate toll and collect tolls. Failure to pay the toll is an offence.

Now this is where it gets vague...
    Scenario 1
Presumably the offence is punishable by a fine set by the road authority. This fine increases from €3, then €40 to €100.
The toll company is authorised by road authority to collect the fine+toll (and possibly keep it too).

    Scenario 2
Toll is actually €146 but is heavily discounted for prompt payment. This is the same principle as the Standard Fare for Luas.

In either scenario it may be legal to charge more than €3.

Maybe. They certainly are if they leave it so long that that's the fine!

I don't understand why people here are going through it regularly and haven't signed up for video registration? It's completely free if you go with post-pay; you save 50c a trip and you don't have to worry about forgetting to pay.

I think current tolls are under the Roads Act. The actual operation of the tolls are governed by NRA bye-laws.

slightly OT but has their website been sorted out yet?

i remember i tried to register my mam's car just before the M50 went barrier free cos she goes up and down quite a lot but the website was a disaster and really really slow. I tried it 2 or three times and each time was as bad so i jus gave up. It was just easier to pay the extra 50c.

they are trying to sue me at the minute. walkin is less hassle

The M50 has lost me as a customer, I have only used it once out of curiosity since they removed the barriers and that was on a motorbike. When I drive I simply detour through Lucan or the Phoenix Park. Fortunately I never need it during rush hour traffic.

Has been okay for me for the past few months. They have a different website now to the one they had just before August.

I still haven't been able to pay the outstanding toll and still haven't received a letter with the UTN number. It seems there's no other way to pay when it's late than with a UTN number. What are you meant to do?Since I left my name and a contact number last week I've heard nothing. I submitted a second online query in the hope that I'd have more luck that way but I'm still waiting. It's now more than three weeks since I passed through the toll. Grrr.

 I've now submitted THREE online queries and left my name & number but have STILL heard nothing and have not received a notice in the post. How do you get to talk to someone on the 1890 number? I can't seem to pick the right menu options; perhaps if I spoke to someone I could pay it.

Ring them up and either press * 0 or the # button; one of these should default send you through to an operator.

I finally reached a human being on the 1890 number for eFlow and apparently my account is clear! Can't figure it out but at least it's clear, phew.

  • Registered Users, Registered Users 2 Posts: 373 ✭✭desertstorm

on average, how long does it take for eflow to send out the first penalty letter?

thats stupid again ..i have to pay 3 euors i didnt pay ...give at least 30 days and then u can give me penalties ...but they are affraid that the amount will gather up and if u cross 40 time s a day....uuuu ...milions are coming....and somebody needs them now......not next month ..today.....:)))so....:"put your hand in the pockets ..and it should be money there ,...get the money ..and pay for my dinner...(toll)....now...."(training day):)))to pay or not to pay....if..they would give 30 days to pay 3 euros i will pay ..if they will impose penalties on me..i will not pay....at least if i get penaltiees i didnt pay so more cider for me:))))less for them....and off course at some stage a nice bed for 3 6 months and some free nice food:)))but hey at least im drinking the cider here:))))my money my cider:))))so give 30 days i give u 3 eruo..force me to pay by tomorrow night ....well...force.. me:)))but than again i saw trhey have some internet tag option or stuff...

That's stupid again. I have to pay €3 I didn't pay. Give at least 30 days and then you can give me penalties, but they are afraid that the amount will gather up and if you cross 40 times a day - milions are coming - and somebody needs them now, not next month, today. So "put your hand in the pockets and it should be money there, get the money and pay for my dinner (toll) now" (training day) to pay or not to pay. If they would give 30 days to pay €3, I will pay. If they will impose penalties on me, I will not pay. At least if I get penalties I didn't pay, so more cider for me, less for them. Of course, at some stage a nice bed for 3 6 months and some free nice food. But hey at least I'm drinking the cider here. My money, my cider. So give 30 days I give you €3. Force me to pay by tomorrow night, well force me. But than again, I saw they have some internet tag option or stuff.

I think I spotted a mismatched parenthesis there somewhere ...

Back in 2009 I didn't pay the toll for two trips. Ignored the first letters and subsequent ones.
Ended up getting a solicitors letter from a law firm in Kerry stating I had 7 days to pay a large fine (€360) or they would take me to court. Had to pay then.

All my fault I know, I was young and a bit stupid. Naturally I shortly after set up a proper account for my m50 trips!

I missed paying on a recent trip, thought it was 48 hours not the 8pm following day. Rang two days later to pay for that days trip, and explained the earlier one too, got charged normal price for both. Happy days.
