What are my rights regarding this?

    Hiya,
    I'm not asking for legal advise or anything - just curious as to what my rights are concerning this.

    I bought a PC from a German company a year and a half ago - at least I tried. I sent them the money via bank transfer - they took a few weeks to try and build it as the parts I chose kept going out of stock.

    So finally after a few weeks, I withdrew the order and got my money back - no PC built or anything.

    Now basically, during the request of building of the PC, one part went out of stock, so I said, fine, use x part instead, and give me the difference back. They gave me 70 euros back and said they would use another part and continue to progress with the order. After this, I cancelled the entire order, and got all my original money back - ie. all of my money which I originally gave them - PLUS the 70 euros which they gave me earlier.

    So I was up 70 euros. I thought, hey, since they have screwed me around so much, I'll say nothing.

    Now a year and a half later, they have emailed me saying that they have given me a double allowance, and want the money back within 14 days otherwise they will take legal action.

    I also have to state at this point - the entire email is in German - not a language I speak - I used an online translator to get the general gist of the email.

    What are my rights here? Can they really claim the money back a year and a half later, when it was their fault in the first place?

    Be nice and give them back their 70 yoyo , just for moral grounds.

    But tell them it's going to take a few weeks to find the parts of the 70 euro , as it's out of stock at the moment. They won't really see the humour , but it might make them think about it.

    Failing that you should definitely ask them to post you a copy of the refund they sent.

    As for paying, I'd think that you'd have to add another zero to that 70 to make it worthwhile bothering to go any further.

    They will do nothing for €70. No one is that mad.

    Just read this bit again. Over a year later! If it was the other way around – you'd overpaid and come back over a year later, they would say too late sucker!

    So is there any laws regarding this? ie. consumer law or anything?

    Just want to be able to state the law to them in case they try and pursue it further - if it was the other way around, I know they would tell me no, so theres not a hope I'll be giving it back to them

    There would be numerous legal hurdles for them even trying to recover €70 off you.
