A friend whose hours is being cut..is there a minimum number of hours?

    Hey,

    I'm hoping someone might have some advice here. I have a friend whose hours have been progressively cut in the last couple of months, and he's now sort of in a limbo while they work out the details of moving him to a new place of work (he works in security).

    This week he is due to work only 6 hours, tomorrow. That's it for the whole week.

    This is my sister's boyfriend, and according to her, it was previously a temporary contract with a minimum of 20 hours a week, but was changed then to a full time contract.

    In either case, is there a minimum number of hours he should be paid for regardless of how many hours of work he actually is given?

    I vaguely recall in a previous job of my own (temp retail job over xmas), that they continued to pay me for I think 8 hours a week for a while after xmas, even though they didn't actually have the hours for me.

    I'm slightly concerned my friend is going to be taken advantage of here, not least because he's a foreign national.

    Any advice would be greatly appreciated. Thanks!

    I think an employer is only obliged to pay your friend for hours worked unless there is a contract agreement in place, please correct me anyone if I am wrong.

    One thing would be that if he has a letter from his/her employer to state they have only a certain amount of hours work available per week it would be possible to sign on for the other days.

    This might be of course subject to terms, amount of pay in question and possibly a means test situation! Check out the citizens information website for help on the topic.

    if he is on a salary, which I doubt, he would get paid the same each week regardless of hours worked even though if I was his employer for a salary I would have him working the max number of hours he could not just 6.

    if he is paid by the hour he is only entitled to be paid for hours worked unless something to the contrary is on his contract. as for just working 6 hours there might be a minimum hours clause in his contract which states basically no matter how bad things get he will be given X hours each week. lay off/redundancy would be next if things were bad also.

    did he get paid for the 20 hours on his previous contract even if he didnt work them?

    get his contract and read it. he can ask his HR dept for a copy he is entitled to it.

    if they are moving him they might just not have the hours for him at the moment hence the minimum amount of hours.
