    I was involved in a car crash over the weekend which I wasn't my fault.
    My problem is that while physically I'm fine, the stress of the accident has affected me mentally. I'm been treated for a very mild anxiety disorder and had weaned myself of my meds and was doing great. But since the weekend I'm feeling stressed out and anixous and having difficulty sleeping. I'm don't agree with the compo culture that exists here and therefore Iam extremely reluctant to lodge a claim.

    If I go ahead with the legal case will I have to visit doctor and doctor and be seriously out of pocket?

    I'm not looking for any legal advice just help from someone who has been through something similiar. The reason I'm posting here is that I've already spoken to a Solicitor who told me I had a case but is he seeing big fees for himself ?

    If the crash wasn't your fault, then you have a case. If your mental health was affected from the crash, you can claim from the other persons insurance company. The Solicitor is only nessacary if things need to goto court. Try and organise a set fee with the Solicitor or maybe a percentage of the winnings. Keep all receipts for doctors, counsellors and such. You'll have to explain each and every time you visit. Don't be bothered with the image you'll receive, as if it was them in your position, they'd do the same. You have a case because you were treated for the condition.

    If it goes to court, you will only have to goto a doctor to prove your mental state. You could even get your doctor who subscribed you medication to testify on your defence.

    In general, hiring a solicitor vs. self representation yields both a higher success rate and a higher return on your compensations in court, in my experience. Yes, they profit, but some solicitors will work on a no win no fee basis. In that way they share as much risk as you by going to court with your case.

    How will a legal case help you? Everyone who has been in a crash or accident of any sort will be shock up after it. You just have to move on and get on with life. As long as your car has been paid for by the insurance forget about it and get on living....

    I was ill earlier this year and had to take medication, I had weaned myself of the meds and I was feeling much better but since Sunday I'm back to square one again, I'm back on the medication and feel just as sick as I did earlier this year. The problem is due to my pre exisiting condition forgetting about it and moving on are not as easy as it sounds. If the accident hadn't happened then I wouldn't be sick again.

    You should count your lucky stars that you weren't injured in the accident.

    Everyone feels anxious from time to time, it's just part of life.

    Running to a solicitor for compo will only make you feel more anxious.

    Use your xmas holidays to chillout and have some fun.

    You can always sue for the minimum amount. I know of a woman somewhere in the states that makes a mission out of filing suits against walmart for failing to correct their pricing errors:

    And once against K-Mart for charging sales tax on toilet paper. Not everyone is after $54 million Pants.

    If youre not into the compensation method OP its not like you need to sue for $500 when your medical bills are $150 and your legal fee is $80. In that case you only need sue for $230. No profit in it. Just justice.

    Thanks to everyone for their advice, it's been really helpful. I'm extremely grateful that I'm not seriously injured. I've never been involved in an accident before and I hope I never will be again. Thanks Overheal for the advice so far I've spent €300 in medical bills and to be honest all I want to do is recoup these costs.

    I think that no matter what happens in your life, there will always be some sort of trigger for your anxiety. It's not really about the crash - that's incidental.

    If you are the sort of person that suffers anxiety, you will always find a reason to be anxious, regardless of who is at fault, whether it be a careless driver, a car backfiring, a domestic argument etc etc

    Maybe you need to talk to someone about managing your stress level, in addition to taking medication.
