Planning Permission for Driveway

    I posted a few weeks ago about getting planning permission to widen our driveway. I got a lot of helpful info here, thanks for that :) There is a bit of a twist in the tale now though but didn't post to the original thread to save people having to read through it again!!!

    Yes, we do have to apply for planning, that much was agreed. However, today I found out that the estate has not been handed over to the County Council yet.

    Is it kind of pointless applying for planning permission when technically the road/footpath etc are not owned by, or under the care of, the County Council??

    Depending on what people here think I was thinking of writing to the developer, he who technically still owns the road/paths outside my property. I would wish to discuss the implications for him (if any) and ask if he had any objections to me proceeding with my changes.

    I am NOT trying to get out of applying for permission, quite the opposite. I have a neighbour that swings hot and cold and I want to make sure I have everything perfect before I proceed in order that we can answer any objections he has etc. It would probably be easier if we could apply for planning permission, then at least it would all be approved and any objections resolved early in the process:)

    Really what I wanted to know is that considering that the roads etc are still private property where do I stand?

    Quick reply. Get your planning permission. When applying get a letter from the developer giving you consent to make a planning application for the works that lie outside your boundary wall - ie. lowering footpath dropped kerb etc.
