Returning early from sick leave?

    I am out sick from work at the moment - recovering after a minor operation - I told work I would be out for about a week and would be getting a sick cert for this - this was fine.

    My doc has since given me a sick cert saying i am unfit to work for 2 weeks, as the op was slightly more complicated than she thought. I feel fine and able to return to work by the end of the week. I also dont want to piss off work by taking a 2nd week i hadnt warned them about as they may be short staffed.

    Just wondering are they legally allowed to let me back to work after 1 week or would it be illegal as a doctor has said i am unfit to do so for another week?

    Why don't you ring your employer and see what they think? Personally I would trust the doctors advice and stay home.

    I would say they will refuse to allow you on premises. If they did allow you back early and something did happen as a result they would be wide open to litigation. Not saying you would or anything but from their point of view they have to cover themselves.

    If you're working in the 2nd week after medical advice and you do yourself an injury its your works insurance that'll have to pay. So its not illegal but it would be in the interest of your work to let you have the 2nd week off.

    Doctors advised you to take 2 weeks so take them they know what they're talking about. No point in going back to work, f'ing yourself up and being out for months.

    Actually I'd say that it is the company that would end up paying as they let someone work who was certified not to be suitable for work (i.e. the insurance would not allow the person to work).

    if you want to go back. go back to the doctor if he thinks your fit ask him to adjust the cert, sorted.

    Yup, another cert. stating that you are fit to return.

    Didn't think of adjusting the cert, that makes sense - hopefully the doc will agree to do it, thanks for the replies!
