Car not transfered when sold

    My girlfriend sold traded in her car 3 months ago against another one. He old car was put on carzone by dealer and a few days later disappeared, so it must have been sold.

    2 weeks ago she got a letter thru the door asking she pay the M50 toll for her own car, and then last night 2 Guards called to the door looking to ake her to the station as she'd apparently been involved in driving way from a petrol station a few weeks back and they hadnt been able to make contact with her. Turns out it was on the old car and her details were on the system.

    She wasnt around last night when they called, but has to call them back today when he's on duty.

    Just wondering if this has happened to anyone else on here before, or whats the best course of action? Contact the garage or let Guards to that?

    Depending on who was supposed to send on the ownership transfer form, contact the dealer and get them to help explain the situation to the gardai. This is a criminal matter now and she needs them to help her case.
    She may also need a solicitor!

    When she bought the car, the dealer filled it in with her and posted it off for her. Hers was changed in a week or so.

    First ring the Motor Registration Office in Shannon and verify who the current registered owner of the vehicle is. If it is still your girlfriend then I'd be down at the door of the garage looking for an explaination as 3 months is taking the piss.

    Most likely they put the VLC on a pile with others and it fell down behind the desk. I bet the bank draft used to pay for the car didn't suffer the same faith. :rolleyes:

    Its simppe enough, you should have a green copy of the SIMI order form, on this it will have details of your car traded in, and the date it was done or the date you collected the new car.

    It may have the registration or the chassis number which can be used to confirm it, dig this out and bring it to the gards. I would not go running around after this, bring it to the gard, explain that you are very busy, they have already taken up some of your time, politely, and ask them can you do anything to help?

    There can be serious delays with cars being registered in new names, and since the post to them is not registered it is difficult for the dealer to prove he posted it down,

    Stick to the facts, when she sold / traded in the car, who she sold it to and the copy of the receipt. If she has any bank records to back up the transaction, i.e. receipt for a bank draft, etc... bring that along too. After that the Gardai can do the work. In an extreme case they may call her as a witness if it ever goes to court.

    But, forget ringing up and being put on hold for the motor tax office, just use their online service.

    I never said they stole our money, my point is that there is alot of sloppiness around sending off the change of ownership details by some dealers/traders and it is becoming more common these days. The same cannot be said with regards lodging payment cheques or bankdrafts by the same people, that manages to be done very efficently and quickly, they very rarely get lost or are put on the long finger. Priorities are different.

    +1 on this. I checked something I bought a few weeks ago and it shows up so you will be able to see if the garage sent the forms or not

    Sorry to hear your girlfriend is having so much hassle with her car. I have a similar issue with a car I sold traded back in July. I got a notification in the post recently for seven toll charges for the car I sold. I went to eFlow.ie and logged a dispute and called them this morning to see if I needed to do anything else and was told that if the dispute isn't resolved in 10 days that they would contact me by post and ask to forward on proof that I no longer own the car.

    Now what I'm worried about is that when I traded in my old car I filled the VLCs for both cars at the garage and the salesman said he'd fill them out and post them later. Now whenever I've bought a car it usually only took a couple of weeks for the change of ownership to go through but after a month of checking motortax.ie I still didn't get the new VLC. After numerous phone calls I was told several excuses eg.the girl in the office forgot to fill it out, it was misplaced in the office, he thought he sent it in the post etc. At this stage I was getting a bit worried because when I bought the car the tax disc was up since Jan and there was no way to tax it until the ownership had changed to my name. I called into the dealership in person and the salesman was very apologetic and promised that he had sent it off himself last week and gave some excuse that basically that it was someone else’s fault that it didn't get sent. The change of ownership finally went through in Oct, three and a half months after I bought it and because I had to back date the tax to July I had to pay extra for the months in arrears. Now it seems that my old car has been sold and the same thing has happened again, while I do have the Vehicle Order Form to prove that I sold the car it looks like I'm going to have to go back to the garage and keep hassling them to make sure the change of ownership for my old car goes through.
    From what the salesman was saying it seems that dealers are reluctant to transfer ownership to their name especially since the barrier-free toll came in because then they get sent any toll charges or speeding fines but surely it can't be that hard to to something as simple as sending off a log book, as a previous poster said they aren't so inefficient when it comes to processing payment.

    Anyways that's the end of my rant, I'd definitely advise anyone buying a second hand car to either post the VLC themselves or wait until the change of ownership has gone through before taking it from the garage.

    They wont, but they will tell you whether or not the name you give them is still the registered owner. they will also send you a letter to say when you ceased to be the owner.

    I've done that a couple of times in the past/.

    I'd imagine it's a backlog at Shannon that has caused this problem, or else the fact the Garda system doesn't automatically update with details from DELG.

    In fairness, with the massive slowdown in sales, there shouldn't be any backlog!

    There isn't much of a backlog at all, I had my new VLC back to me 4 days after posting the old one about 3 weeks ago.

    FYI, if you move to a 'smart' meter electricity plan, you CAN'T move back to a non-smart plan.

    You don't have to take a 'smart' meter if you don't want one, opt-out is available.

    Buy drinks in 3L or bigger plastic bottles or glass bottles or cartons to avoid the DRS fee.

    I worked in Motor tax a few years ago and I had to deal with similar queries all the time. Some motor dealers seemed to never send on the VLC/VRCs. If your worried, you can get an affidavit stating you are no longer the owner but like someone already said the MTO can post you a letter stating date you sold the car.

    Girlfriend called the Guard last night, he took the garage details and said he would deal with it from there. He apologised for them calling so late in the night aswell

    Also said to give the garage a call and give them hell for putting her in that situation.

    From previous experience I wouldn't be surprised if the garage did the transfer correct but the Gardai computer was out of date by 3 months.
