Court Summons

    I posted a few weeks ago about my upcoming court apperance and want too say thanks for the response. I was looking at the summons last night and noticed the place on the summons where the offense(on Mobile phone) took place is wrong. Can i have this struck out?

    tbh i dont think it would. it used to be the case that if there was a simple mistake on the summons like a spelling mistake or wrong date that it would be struck out, but nowadays they dont seem to let people off quite so easily.

    I was actually in court yesterday for a motoring offence myself and i was very surprised how strict they were. they were handing out fines and disqualifications like they were going out of fashion. there was a guy there who was accused of talking on a mobile phone while driving and he was arguing that he wasnt talking but he agreed that he did have the mobile phone in his hand while driving. but the judge said he didnt care if he was talking or not, he still had it in his hand while driving and continued on. the guy gave a bit of a sob story about it being an urgent text message so i think he got away with a €200 fine.

    another thing to note is if you ever get a case struck out due to an error, the garda can apply to have you summoned again so it can sometomes be best just to get it over and done with and not to have to worry about it again.

    good advice from the previous posters. Also; Don't be a douche. You admitted already you were talking on your phone, you deserve the fine/points/beating. "I want to get away with breaking the law and putting other drivers at risk" isn't a personal issue.
