    I read this elsewhere that is apparently part of the PS3 EULA
    "We cannot monitor the whole of PSN and make no commitment to do so. However, we reserve the right in our sole discretion to monitor and record your online activity and communication throughout PSN and to remove any content from PSN at our sole discretion, without further notice to you.

    "Any data collected in this way, including the content of your voice and text communications, the time and location of your activities, and your Online ID and IP address, may be used by us to enforce the PSN Terms of Service and passed to the police or other appropriate authorities. By accepting these Conditions, you expressly consent to this."

    Most people probably would never become aware of this. I'm going to have a think about this while I'm stuck in traffic shortly but I think its a gross invasion of privacy. Anyone have thoughts?

    I wouldn't say so max.

    It depends on a few things. If it is proportionately done so, then no. BUT, if it is done so in such a way as to breach an individual's privacy with no public interest/security concerns to back that breach of privacy, then yes it probably is.

    Correct me if I'm wrong (almost sure I'm not), but most universities, companies, and ISPs work on the same principle, or to put it simply, have the same type of clause attached to all those that connect using their systems.
