big paypal dispute

    just need some advice

    i bought an item on ebay from the uk

    bought it on the 30th september

    only arrived late on the 13th

    saw on the royal mail stamp only shipped on the 8th of oct

    i emailed the seller on wednesday the 8th complaining that i havent recieved the item

    the seller told me if i dont get the item by friday 10 oct ill get a total refund and i was to send back the item

    so no item on the friday and i complained to the seller,not a word back from him so i gave him by sunday to reply but nothing so i opened a dispute on paypal

    the seller got back to me today saying that ill have the item for half price if i want id said ya

    but the catch was to cancel the paypal complaint first
    id said "no, refund first and ill cancel the complaint"

    the seller then said "paypal will only let him refund the whole amount"

    id say (if he refund me the full amount id pay him the money hes owed)
    stupid mistake i know **** it

    but with quick thinking i sent a paypal request for the amount im owed after the stupid mistake


    but the seller then emails me saying

    I am providing the tracking number of the ebay item sent to the buyer and was received on the 13/10/08 before 12.00.
    buyer has confirmed through emails that he has received the mobile phone.
    I must also add my disappointment that through additional emails exchanged I have offered a partial refund to the buyer
    Since offering the partial refund to buyer he has since used the PayPal claim as a blackmail asking me for a full refund to a different PayPal address in return he would drop the claim he has made against me.
    I see this as balckmail and I hope that PayPal take this very seriously and any additional information needed I will provide.

    he had the wrong name on the box too

    he tried to pull a fast one on me

    he tried to make me cancel the complaint first so ill never hear from him again

    and i have only 1 paypal address so he's ****ed there


    so where do i stand

    What is seller's feedback profile like & your own - could be used to back up your case if you have 100% perfect postitive feedback.
    Leave the dispute open, let Paypal decide who is at fault. Keep all emails from this seller if required as evidence. Maybe worth updating Paypal on seller's behaviour.
    I have had full and partial refunds via Paypal from sellers for stuff I bought on ebay before so seller's story is a load of bull.

    sellers feedback is 856 (positive 99.6%) mine is 114 (positive 97.4%) only ever 1 bad word against me

    so a bit of a difference but i have all the emails kept in a safe place

    also i cant respond to anything the seller says untill after 2 days

    the seller responed to the paypal complaint with a tracking number for the ebay item


    to be honest i rather keep the item

    gave it to my brother for a early christmas gift but its the ****ing principle of this whole matter
    trying to pull the wool over my eyes

    i rather the partial refund but i dought thats coming
    its either the phone goes back or ill keep it

    cant let this die

    the seller responed to the paypal complaint with a tracking number for the ebay item

    The important thing here is what does the tracking info reveal when you enter in on Royal Mail's and An Post's sites? Does it back the sellers claim that you received it on the 13th? If it does, Paypal will side with him. If not, they'll side with you.

    On his blackmail claim, Paypal will ask him for the emails in which you supposedly said this. When you next get the opportunity to respond, tell them that you have all conversations and are willing to provide all of it if necessary, and that this blackmail stuff is a blatant lie by the seller.

    Paypal also advice that you never cancel a dispute until it is resolved, so his request for you to cancel it will go against him where Paypal is concerned. Also, Paypal do allow sellers to give a partial refund, so that's another lie from him.

    I also assume this is in the "claim" phase, and not still as a dispute? If it's still in dispute, then Paypal won't even be looking at it yet.

    the tracking number shows up on royal mail website and an post

    so im screwed even dought i was promised the item by 10th of oct and a full refund

    i had to buy a replacement because of work

    but the amount of times i asked him for the tracking number but nothing
    the phase that was in was it was waiting for the seller to reply within the 10 days

    You got the item, claim closed. Pretty much in a nut shell.

    As far as PayPal claims go you can not claim for delayed or late delivery so the refund you were promised is gone now, unless the seller wants to give it to you but he has no obligation to do so.

    I'd be happy that the item arrived if it were me...

    ya i had to cancel the complaint

    im happy it came but not happy with the sellers accusations and the very delayed postage

    bought on the 30th sept sent on the 8th of oct
