Trying to move out; letting agent ignoring us

    We've been in our house 16 months and at the moment are in a 'part 4 tenancy' as we have not signed a lease for the second year.

    At the start of the month we informed them of our intention to move out, the letting agent was sympathetic and said she'd speak to the landlord and call us back.

    Since then...not a word.

    We've rung, emailed, and no response.

    Yesterday we rang and were told she is 'on holiday' and would be back today. Strangely, she didn't have her out of office notification on her email as she has in the past when she was out of the office...and needless to say, she still hasn't called us back.

    What exactly can we do? It's 2 weeks til the end of the month and we really need our deposit back..

    You should serve written notice of your intention to leave in XX days (whatever the notice period under the RTA 2004 is). Send it via registered post. Then you can prove you've served notice of termination.

    Until you've done that, you haven't served notice technically. So if you really need to be gone in two weeks you have a problem. Just keep hounding them. I don't see why it has to be that specific person who deals with you. Circumvent!

    Has to be written, keep a copy for yourself, there's a template for it on threshold.ie.

    Legally, they don't have to do anything until you've sent that in.

    Astrofool is correct...It is critical that your Termination Notice complies with all the requirements as set out in the Act both in terms of notice given, exact format etc. You should find a template on the www.prtb.ie website. Follow it exactly & keep a copy in case of dispute.
