caught being paid cash while on the dole

    Hi

    I'm wondering if anyone knows what happens if you're caught working for cash while on the dole?

    Also are there any consequences for the employer?

    Yes the employer would get into trouble as he would not be paying PRSI for the employee and the employee wouild be cut off the dole pending an investigation and both are usally prosectuted.

    Yeah I'd imagine being caught working and being paid in cash whilst simultaneously claiming the dole could result in a prosecution along with your name and details being published in the newspapers and on the radio.. Not a nice situation to be in!

    not much consequences for the employer unless he was dodging taxing you..in that case its an offence

    you also committed fraud,so will probably have to pay the dole back whatever was given to you by them or pay a fine, cos they were thinking you had no money or work

    so its fare really, actually its very fare

    There are usually serious consequences for the employer. The employer will not have been paying PAYE/PRSI. These will have to be paid as well as interest and penalties. the employer must have been getting the cash from somewhere and he will be audited and the source of the cash identified. That will result most likely in further payments of income tax and possibly VAT plus interest and penalties.
    That is all in addition to any criminal charges under the Revenue or Social welfare codes.
    Thus an employer like a garage who gets cash from customers for car repairs and pays a mechanic cash may find himself paying up big time if caught.

    In an ideal world yes....but have you seen many cases where employers have been held accountable in such circumstances....I have n,t.

    thanks all for your help.
    it's actually a friends friend who facilitated a worker by paying cash because her husband is on the dole.
    She walked out, and has actually gone to solicitor and sent in letter re unfair dismissal and no contract of employment.......
    just wondered if anyone knows anyone else that has "been caught" -from either prospective.

    The employees fraud is against the Social Welfare people, The employers fraud is against the Revenue Commissioners. Both operate differently.

    You may not hear much about employers being done for defrauding the revenue, but their details do get published if they either come to an agreed repayment arrangement or are prosecuted.

    My advice to your friend of a friend, when it goes to court they should plead guilty as soon as possible,

    I have been working paying prsi etc but am also claiming social welfare.... I have advised the dole office and am not sure where I stand now... any clues anyone,,, no one I know knows anything about social welfare system??? I am working on average about 20 hours per week

    I am working for the past year on an on call basis.... about 5 hours a week? but as I get paid after 2 months the money can look quite a bit... ie about €1k,,, but as I never know when I am next going to be called I have always felt it not worth my while advising sw?
    As I have been getting a few more hours of late I informed the sw but am scared of what is going to happen now, as they will be getting the paper work from my work?
    does anyone have a clue

    Well firstly this is a zombie thread, so create a new one.

    Secondly, I would get your story straight, you are working either 5 hours or 20 hours? Which is it? Wether you are on call or not doesn't matter, you are working.

    Who's to blame that you don't know how the system works? If you are working you have to notify SW, it's incredibly simple really. Claiming ignorance won't help here. Talk with your local social welfare office and see what the story is, don't be telling porkie pies though, you'll only dig yourself into a hole.
