Signing Waivers for sporting lessons

    Hi, does anyone know if you sign a waiver for a sporting lesson and you have an accidient (quite a bad one) during a lesson, do you have any come back at all ? A friend who is at intermediate level had a serious accident on a horse riding lesson due to a reckless action of the instructor. I guess horse riding schools have public liablility but does a waiver cancel this out alltogehter ? Thanks

    Your friend really needs to speak to a solicitor. There are many out there, and some who would specialise in accident injury cases.

    My understanding, is that a waiver does not cover them totally, and your friend will still be able to make a claim. But, your friend would need proper legal advice from a solicitor.

    As Paulw says.

    A waiver does not exonerate someone completely from public liability, but does prove that the person who signed it was aware of the danger before participating.

    Your friend needs to talk to a solicitor as anything else would be legal advice.
