If an employer breaches certain employee rights, where can you report them?? ie. not getting a payslip, bullying etc...

Is there a general body that deals with all employee grievances or must each one be taken to separate relevant bodies??

    Thanks in advance :D

    Labour relations
    The labour court
    The employee tribunial
Your union is the first stop, or if you haven't joined one then join one.
    Try siptu.

NERA (national employment rights authority) will deal with many queries, such as incorrect pay, missing payslips, etc. Their website has a lot of information on your rights as a worker, and what rights NERA can attempt to enforce for you. They also offer advice on proceeding to the labour courts or higher if necessary. There's an application form where you can detail the problems you are having, and if needs be, NERA can inspect an employer and levy fines if violations are found.

For tax related issues (e.g. missing p45, incorrect tax, etc) you'll have to deal directly with your local tax office. You can talk to them on the phone, but if you want them to take action, you'll need to submit in writing.

If you don't feel that either of these bodies can deal with your query, then I suggest calling Free Legal Aid and asking for their advice.

Yep, Nera is your first port of call. Don't bother with a union if you're not already in one.

NERA is the first and only place I would recommend.

Do not be joining a union for gods sake...

All information is available from NERA

You can make a complaint to

Health * Safety Authority re H&S issues

NERA re issues on payslips, working time, hols, redundancy payments
Each act is governed by different entities,,, but NERA or even the Citizens Information Bureau will be able to assist. Note NERA is not an advise centre just information point.

NERA have been given an increased mandate to follow up compliance issues with Employers.

They have the right to enter premises, right to inspect records, right to speak to anyone.

They can come announced or unannounced

They prefer compliance to sanction but sanctions on employers can range up to 5k or 12 months imprisonment through District court or 250k and 3 yrs under indictment. However each piece of legislation has penalties also for breaches by employers as well.

Following a complaint they will act and they have about 90 inspectors:rolleyes:

First stop the Union. They will look after everything for you. Its well worth joining one and its only a couple of euro a week

DON'T join a union, it's a waste of money and in my experience their reps aren't qualified to give advice! Many employers won't recognise or deal with unions and they are perfectly within their rights to do this.

OP - speak to NERA. They are really helpful and will be able to take action against your employer if they are breaking employment laws.

100% agree unions waste of time, probably end up worse than it already is if they get involved.

100% agree. Stay away from the union! If there isnt one in work already and there is no union agreement in place, the company can and perfectly entitled to refuse to deal with a union even if you have joined one.

NERA is the only port of call really
