For the first time ever google has let me down.even in board.ie I wasn't too sure where to post it. Please move if it's in the wrong place. Parter is currently in jfk and has just spent last couple of hours answering questions with security there. As far as we know there is nothing to single him out. All they would tell him is that his passport was being flagged as a B10. We've another two trips to USA this year so I'm a bit concerned. Does anyone know what a B10 is?

Not sure this is best served in Politics.

I would imagine that it would be Abroad or Legal Discssions (we don't seem to have an Immigration forum).

I'm going to guess that B10 would be an immigration article rather than a flag code and move to Legal Discussion. I think that in either case, you're more likely to find and answer there.

I would suggest you get him an attorney, even if there isn't a major problem.

Contact the Irish embassy and / or local consulate, who can go along to represent and can recommend an attorney. http://www.dfa.ie/home/index.aspx?id=5535

Small problems with the lawyer option. Firstly, it's expensive. Worse, being awarded 'costs' is rare. Even worse, bear in mind that as he has not been admitted to the country, the Constitution, and the assorted rights to courts, process and whatnot do not yet apply. It's a totally different kettle of fish to being picked up by INS on overstaying your visa. The regs state how long a person can be held before either being admitted or deported. You will very quickly pay more money for a lawyer to help him than it would cost to simply buy another 'plane ticket should he be returned to country of origin.

The only 'B-10' reg I can find which may apply is in 8 CFR 245.1, which isn't entirely on point as it involves a change of status for aliens. B-10 is a violation of employment terms. (i.e. working without a visa). Assuming he hasn't been a little liberal with his activities in prior visits, this probably isn't it, and I have absolutely no idea what a B-10 is.

You're better off taking no action now. There is nothing you can realistically do in the time alotted to change DHS's decision on this trip. After he gets back, you really need to visit the US embassy to clear up whatever happened. Don't rely on the officer in JFK saying "OK, we've sorted it out now"

Sorry, I wasn't very clear in the first post. He spent a couple of hours being interviewed and then was allowed to continue his journey. It was as cordial as US immigration officers can ever be ;). I was just wondering what caused him to be flagged and if it is likely to happen again. It was only his second ever trip to the USA but as they are the experts in the sports we do, it's likely there will be many more trips. Thanks for the advice.
