does an employer have to hold your job if you are sick

    Hi, I was just wondering about this question. A firnd has been working for a compnay for 9 months part-time and she needs to have an operation in which she will be off work for 6 weeks. Does her boss have to hold her position or can he fire her? Advice is appreciated, thanks.

    What (if any) reference is made to sick leave in her contract.

    Remember, the Unfair Dismissals act will not apply, and this favours the employer in this case.

    I vaguely remember reading if her sick leave is affecting her ability to do the job, she can be let go.

    Her employer is not obliged to hold onto her job. Assuming that the contract has no provision for sick leave, then being unable to do her job for the best part of two months is reason enough to let her go, if ridiculously callous.
