Euro Car Park Fines - Are they enforceable

    Hi

    I recently got a fine from a Euro Car Parks for overstaying the free period in the car park by 5 minutes.

    I was just wondering if they have access to the vehicle registration database to take the matter further if I don't pay it.

    Basically I'm wondering if I dump the parking ticket can they do anything about it.

    They don't have any information about me other than the reg of the car

    Was wondering the exact same myself about six months ago.......still have the ticket sitting at home.......unpaid!!! As far as i know they can only clamp your car and charge you for the release but they cannot fine you. Dont take this as gospel but like i said, mine is still sitting at home after 6 months!!!

    From reading the fine I feel you are correct.

    It says I can be clamped and that the release fee would then be €80.

    I'm going to ignore it anyway.

    I left my old car overnight in a "free" car park.

    Next day I had a similar ticket basically saying that if I did it again I would be clamped.

    I'd say you'll be fine once they don't catch you again as I'm sure they probably have you on their own database now

    They can send you all the letters they want but they will never take you to court and if they did it would be thrown out as legally it's a whole grey area which is 100% unlicensed and while on subject the clamping end of things is perhaps "illegal".

    I am fully aware that this is not the answer that the masses want but if you stayed over the time in the car park why would you not pay the fine ?

    I'm sure there are signs everywhere giving the t&cs, the fact its 5 mins over is irrelevant, 5 min, 10 min, 110 mins are all the same.

    Sorry, but I just don't get this attitude in our society, you used their services, you made the mistake and caused yourself to get a fine and now you don't want to pay it? For what reason exactly should you not pay it?

    You knew the terms when you parked there.


    And for the record I have not affiliation with anything carpark or fine related, I just don;'t understand people today.

    EDIT: I'm not being all high and mightly here, I just don't see why people do this?

    I'd be concerned about next time you park in the ECP car park if you don't - their wardens calculate the times on handheld devices that MIGHT have a DB of reg plates with unpaid fines.

    Possibly. No idea if they do or not but the technology is certainly available.

    I work in Stillorgan beside the Tesco overflow car park. Although we have our own spaces outside the building, I often have to park in the tesco car park and so far have three ECP parking tickets pinned to my desk!
    They record all regs digitally BTW

    Anyone any more info on this over the last couple of years? I got one the other day and just wondering if I can get away without paying it....and yes I know I should pay it but times are pretty tough at the minute!

    Im pretty sure they are not legally binding should they ever try take you to court, which from what I have read they wont because they know they wont win. Theres been quite a few threads on this and other forums about private parking and clamping companies; well worth searching them out and giving them a read.

    I would take on board what someone above has said about parking in a ECP car park again tho; they are pretty common and if they do have the technology to track you then you might find yourself clamped. Probably not legally binding either but a PITA nonetheless.

    While normally I agree with your posts mate, you're way off here.

    You're contextualising this as the OP not paying for a service.

    The OP did pay for his service (i.e. the parking) and overstayed by five minutes. I'm sure he would have been more than happy to pay the 20c for the extra 5 minutes he stayed for. Instead, NCP, true to form, try their luck at extorting €40 from him.

    Suggestion to the OP is to throw the fine in the bin and ignore it, as I've done in the past with no repurcussions. You'll be fine because:

    1. They're trying to fine you based on breach of contract. This is a civil issue so let them spend time and effort on bringing you to court for €40. You can be sure that they won't bother to do that.

    2. Even if they did want to bring you to court, all they have to track you down is your reg number. They can't identifiy the owner because the guards aren't in the habit of giving access to the vehicle register to anyone who rocks up looking for it.
